RESOLUTION NO. RESOLUTION DECLARING THAT WEEDS, DIRT, RUBBISH, AND REFUSE UPON OR IN FRONT OF CERTAIN DESCRIBED PROPERTIES WITHIN THE CITY OF PLEASANTON CONSTITUTE PUBLIC NUISANCES AND THAT THEY BE ABATED, AND SETTING A PUBLIC HEARING REGARDING THE ABATEMENT. WHEREAS, there is attached hereto and incorporated by reference herein as if fully set forth a list of properties to which this resolution applies; and WHEREAS, said list of properties specifically sets forth street, lot and block numbers according to the official assessment map for each piece of property; and WHEREAS, the properties list have, upon or in front of them, weeds, as defined by Section 39561.5 of the Government Code, dirt, rubbish, or refuse; and WHEREAS, after consideration of evidence, it appears that said weeds, dirt, rubbish, and refuse are a public nuisance in that they constitute a fire hazard, or that said materials are noxious or dangerous and as such, are detrimental to the health, safety and welfare of the City of Pleasanton and, as such, shall be removed; and WHEREAS, it appears that the public nuisances referred to herein are recurrent and seasonal in nature. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. That the weeds, dirt, rubbish and refuse upon on or in front of the properties described in the list of attached hereto and incorporated by reference herein, are declared a public nuisance and are to be abated and removed pursuant to the procedure provided by Section 39560-39588 of the Government Code. SECTION 2. City Clerk shall certify to the passage of this resolution and enter it into the book of original resolutions. PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on March 18, 2008.
