DRAFT <br />Commissioner Pearce did not see Hap's benefiting from the wall in any way and did not believe <br />the Commission should require Hap's to pay for any of it if it were being built anew. <br />Commissioner Pearce moved to make the findings for the major modification of the <br />approved PUD Development Plan as stated in the staff report and to recommend approval <br />of PUD-81-28-OSM to the City Council, subject to the Conditions of Approval as listed in <br />Exhibit B of the staff report, with the modification that the garbage easement in Condition <br />No. 4 be submitted to the City Attorney within 30 days for his review and approval. <br />Commissioner Narum seconded the motion. <br />Chair Blank noted that he could generally support the motion but was very concerned about the <br />emergency egress. He noted that it is very difficult to egress in a panic situation during an <br />emergency. He inquired whether the solution could be peer reviewed by the Fire Department. <br />Commissioner Fox agreed with Chair Blank's concerns and would like Condition No. 3 to be <br />reworded in such a way that staff could reconsider the emergency access mechanisms and <br />develop an emergency access plan that considered multiple alternatives. She was not confident <br />that a full room of people could not evacuate through the back exit in an emergency. <br />Mr. Iserson replied that the Chief Building Official and the Fire Department had been involved <br />in examining the access and that staff could take a more focused look at the rear exit. In terms of <br />specific obstructions in the back, staff could re-examine the emergency egress to ensure that it is <br />as safe and unobstructed as possible. <br />In response to an inquiry by Chair Blank regarding whether the Fire Department would <br />automatically become involved following examination by the Chief Building Official, <br />Mr. Iserson replied that the Fire Marshal and Chief Building Official worked together on this <br />matter. Chair Blank requested that both the Fire Marshal and the Chief Building Official sign off <br />on this solution. Mr. Iserson replied that would be possible. <br />Commissioner Fox expressed concern about the large number of boxes and a 12-foot-long grease <br />spot by the dumpster, which would pose a hazard to people exiting in an emergency. <br />Mr. Thomas noted that he was concerned about the rear egress and that there were conditions <br />that the Planning Commission could impose that would make the job of the Fire Marshal and <br />Chief Building Official easier. He suggested that painted striping be included on the Hap's side <br />that would define the area that must be kept clear; that would make enforcement easier as well. <br />Chair Blank suggested that the language be changed to: "submitted for the review and approval <br />of both the Chief Building Official and the Fire Marshal." Mr. Thomas believed that would be <br />helpful. <br />Chair Blank suggested the following language: "The design of the gate and the layout of the <br />egress area shall be submitted for review and approval by the Chief Building Official and the <br />Fire Marshal." <br />DRAFT EXCERPTS: PLANNING COMMISSION MINUTES, 2-13-08 Page 11 of 13 <br />
