ATTACHMENT 1 <br />EXHIBIT B <br />CONDITIONS OF APPROVAL <br />PUD-81-28-5M, City of Pleasanton <br />30 West Neal Street <br />January 9, 2008 <br />The masonry wall shall be maintained in substantial conformance to the <br />development plans, Exhibit A, dated "Received, July 10, 2007", on file with the <br />Planning Department, except as modified by the following conditions. Minor <br />changes to the plans may be allowed subject to the approval of the Planning <br />Director if found to be in substantial conformance to the approved Exhibit A. <br />2. The gate as constructed is not approved and shall be re-designed and <br />reconstructed to meet Building Code emergency access requirements. No hasp <br />or other locking mechanism shall be constructed on the gate to restrict it from <br />opening, and the gate shall never be locked or obstructed in any way so as to <br />prevent ingress and egress through the gate. The design of the gate shall be <br />submitted for the review and approval of the Chief Building Official and the <br />Planning Director within 30 days of approval of PUD-81-28-5M, and the gate shall <br />be modified according to the approved plans within 30 days of approval by the <br />City. <br />3. The owner of the Pleasanton Station/Railroad Square property shall record an <br />easement in favor of the owner of the Hap's Restaurant property granting <br />emergency access through the gate in the masonry wall leading to the concrete <br />pad in front of the trash enclosure for Pleasanton Station/Railroad Square. The <br />easement shall be subject to the review and approval of the City Attorney and <br />shall be submitted to the City Attorney within 30 days of approval of <br />PUD-81-28-5M. <br />4. The owner of the Pleasanton Station/Railroad Square property shall record an <br />easement in favor of Pleasanton Garbage Service (PGS) granting PGS the right <br />to enter the Pleasanton Station/Railroad Square parking lot with a refuse truck for <br />the purpose of emptying Hap's trash dumpster. The easement shall further give <br />PGS the right to roll Hap's dumpster from the Hap's site onto the Pleasanton <br />Station/Railroad Square parking lot in order to empty Hap's dumpster. <br />{end} <br />
