THE CITY OF
_ ~
iiiiii ~ ~y 1 111 ~ 1 '~~~~~ I =
L~~S~NT~N~
August 13, 2007
Michael Madden
Red Bear Property Management
5955 Coronado Lane
Pleasanton, CA 94566
Re: Request for Enforcement
Dear Mike:
Thank you for your letter of July 10, addressed to Mayor Jennifer Hosterman. I understand your
concerns regarding the wall between your property on Neal Street(Hap's Restaurant) and the
Pleasanton Station site. As you know, City staff has been working for some time to attempt to
resolve this situation, and I appreciate your cooperation in this process. However, it appears that
these efforts have not been successful and that you desire the City to take enforcement action
leading to removal of this wall.
A City staff member did originally sign off on the wall; unfortunately, this was not the correct
process for approving this wall. ~ Therefore, our next step in following through with your request
would be to initiate the correct review process. This would be a PUD Major Modification, which
would involve public hearings before the Planning Commission and City Council. The City
would notify surrounding property owners and prepare a staff report on the issue. The Planning
Commission would provide a recommendation to the City Council, which would make the final
decision concerning the wall. The Council's final action would be to either approve the wall,
approve the wall with conditions, or deny the wall. Staff will determine when this matter can be
scheduled for the Planning Commission and will inform you of the date.
Thank you for your patience and cooperation on this matter.
Sin er I ,
Nelson Fialho
City Manager
c: Ma or and City Council
erry Iserson, Planning Director
Michael Roush, City Attorney
G°~C~~i~ _.- . _ ~._ ~~
AUG ~ ~7
CITY OF P4 ~- :-;..: ~N
P.
