easily identifiable path of egress is available for its customers in the event of an <br />emergency. <br />4. Another reason for construction of the wall was due to Hap's Restaurant's <br />housekeeping practices concerning disposal of grease and dishwater from the <br />restaurant and the contention by Pleasanton Station owners that this occurred at <br />times on their property. The City has inspected Hap's Restaurant and <br />determined that such violations were not substantial and were corrected. Staff <br />believes that the presence of the wall may diminish such incidents. <br />PUBLIC NOTIFICATION <br />Notices of the public hearing on this item were sent to business owners and tenants <br />within 1,000 feet of the project area. Notification was also provided to the Pleasanton <br />Downtown Association. No comments have been received as of the writing of this staff <br />report. <br />ENVIRONMENTAL ASSESSMENT <br />The proposed project is categorically exempt project from the requirements of the <br />California Environmental Quality Act (CEQA). Therefore, no environmental document <br />accompanies the staff report. <br />CONCLUSION <br />The wall, as constructed and conditioned, provides for emergency access to and from <br />the rear of Hap's Restaurant, allows for Hap's Restaurant's garbage to be picked up, <br />screens the trash area at the rear of Hap's Restaurant from public view, and is <br />attractively designed. The wall would be an extension of an existing property line fence <br />and is not being used to separate or divide parking lots. Moreover, staff hopes that the <br />wall will reduce the friction between representatives of the two properties by limiting the <br />opportunity for contact between them. While staff erred in allowing the wall to be built <br />without using the proper process, this matter is now being corrected, and all issues <br />pertaining to the wall have been addressed with conditions added where necessary. <br />Both parties are in agreement with the conditions of approval as modified at the <br />Planning Commission hearing, and the Commission unanimously recommended <br />approval based on the revised conditions.
