Approved a~ ~o Form <br /> <br /> OCAL AGENCY FORMATION COMMISSION <br /> RESOLUTION 87-1 <br /> <br /> WHEREAS, a resolution of application for Annexation No. ll5 <br />(Ferreri) to the City of Pleasanton, was heretofore filed with the Executive <br />Officer of the Local Aeency Formation Commission; and <br /> <br /> WHEREAS, said Executive Officer has reviewed said application and <br />prepared a report, recommending modification of the proposal to exclude the <br />Lester and Panganiban parcels from the annexation; and <br /> <br /> WHEREAS, a Negative Declaration has been ~repared, and said <br />Negative Declaration has been considered by this Commission; and <br /> <br /> WHEREAS, the City and County have reached agreement on <br />distribution of the 1% property tax distribution, and the City will insure the <br />provision of essential municipal services to the subject area; and <br /> <br /> WHEREAS, the subject area is inhabited and the proposal involves <br />the creation of an unincorporated island, notice was published in the <br />newspaper of when and where this item would be heard by the Local Agency <br />Formation Commission; and <br /> <br /> WHEREAS, the property owners have requested annexation, and the <br />subject area is located within the City of Pleasanton's sphere of influence; <br />and <br /> <br /> WHEREAS, at the hearing on February 19, 1987, the Local A~ency <br />Formation Commission heard and received all oral and written protests, <br />objections and evidence which were made, presented or filed, and all persons <br />present were given an opportunity to appear and be heard in respect to any <br />matter relating to said application and report; and <br /> <br /> WHEREAS, this Commission did find as follows: ' <br /> <br /> 1. The annexation will permit the ~rovision of municipal services <br /> to the subject area; and <br /> <br /> 2. Pursuant to the California Environmental Quality Act, a <br /> negative declaration has been adopted by the City of <br /> Pleasanton. The negative declaration for the modified <br /> annexation is adequate for the Commission's action. <br /> <br /> 3. Overriding considerations outweigh the impacts of establishing <br /> an incorporated island area in that: <br /> <br /> o Denial of the annexation would be detrimental to the <br /> orderly development of the community; and <br /> <br /> <br />
