She believed these situations may be difficult, although <br />not impossible, to enforce. She noted that a sunsetted business that did not wish to stop doing <br />business may have to be taken to court as well. <br /> <br />ROLL CALL VOTE: <br /> <br />AYES: Commissioners Blank and Olson. <br />NOES: Commissioners Fox, Narum, and Pearce. <br />ABSTAIN: None. <br />RECUSED: None. <br />ABSENT: None. <br /> <br />The motion failed. <br /> <br />Commissioner Pearce then moved to make the findings for a non-exempt home occupation <br />and to approve PAP-109, subject to the conditions of approval listed in Exhibit B of the <br />November 14, 2007 staff report, with a modification to the second bullet under Condition <br />No. 13 as follows: “Use on-street parking directly in front of the home <br />, or park on the <br />” <br />driveway. <br />Chairperson Fox seconded the motion. <br /> <br />Chairperson Fox proposed an amendment to the motion prohibiting vehicles exceeding one <br />ton in size or with commercial decals from being used in conjunction with the use. <br /> <br />Commissioner Blank proposed another amendment that the truck size be reduced to a <br />half-ton. <br /> <br />Commissioner Narum proposed an additional amendment that this use include a sunset <br />clause of one year. <br /> <br />Ms. Decker noted that Chairperson Fox’s amendment with respect to trucks with commercial <br />decals would preclude delivery trucks such as UPS and FedEx from being used. Chairperson <br />Fox clarified that she intended to state that the applicant may not use vehicles with commercial <br />logos advertising her own business. <br /> <br />Ms. Decker did not recall any other exempt or non-exempt home occupation being precluded <br />from placing a company decal on their vehicles. <br /> <br />Commissioner Blank did not have any objection to the applicant placing a magnetic decal on the <br />side of the applicant’s vehicle. <br /> <br />Commissioner Pearce noted that Condition 17 stated that no attention-getting devices may be <br />used on the site. <br />PLANNING COMMISSION MINUTES, November 14, 2007 Page 12 of 34 <br /> <br /> <br />
