RESOLUTION NO.O&166 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, APPROVING THE APPEAL OF CASE PAP-115, THEREBY OVERTURNING THE PLANNING COMMISSION DENIAL OF THE APPLICATION OF JENNIFER HOSTERMAN FOR ANIMAL USE PERMIT, AS FILED UNDER CASE PAUP-4 WHEREAS, Jennifer Hosterman has applied for an animal use permit to allow a red-tailed hawk to be kept in an enclosed area in the backyard of an existing residence located at 2922 Chardonnay Drive; and WHEREAS, zoning for the property is PUD-M (Planned Unit Development - Medium Density Residential) District; and WHEREAS, at its meeting of December 12, 2007, the Planning Commission, after having considered all public testimony, relevant exhibits, and recommendations of City staff concerning the application, denied the application; and WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicant submitted an appeal of the decision of the Planning Commission; and WHEREAS, at its meeting of January 15, 2008, the City Council received a report from the Director of Planning and Community Development, together with a copy of the staff report to the Planning Commission, regarding this matter; and WHEREAS, the City Council held a public hearing on January 15, 2008, at which time the applicant and any other members of the public were offered an opportunity to present evidence regarding this appeal; and WHEREAS, after a review of the materials presented, the City Council determined that the proposed animal use, as conditioned, is appropriate for the site and is consistent with the zoning regulations of the zoning district of the property. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: SECTION 1. Approves the appeal, Case PAP-115, thereby approving Case PAUP-4, the application of Jennifer Hosterman for an animal use permit to allow a red-tailed hawk to be kept in an enclosed area in the backyard of an existing residence located at 2922 Chardonnay Drive, subject to the conditions shown on Exhibit B, attached hereto and made a part of this case by reference. SECTION 2. This resolution shall become effective immediately upon its passage and adoption.
