RESOLUTION NO.O&166 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br />APPROVING THE APPEAL OF CASE PAP-115, THEREBY OVERTURNING <br />THE PLANNING COMMISSION DENIAL OF THE APPLICATION OF <br />JENNIFER HOSTERMAN FOR ANIMAL USE PERMIT, AS FILED UNDER <br />CASE PAUP-4 <br />WHEREAS, Jennifer Hosterman has applied for an animal use permit to allow a <br />red-tailed hawk to be kept in an enclosed area in the backyard of an existing residence <br />located at 2922 Chardonnay Drive; and <br />WHEREAS, zoning for the property is PUD-M (Planned Unit Development - <br />Medium Density Residential) District; and <br />WHEREAS, at its meeting of December 12, 2007, the Planning Commission, <br />after having considered all public testimony, relevant exhibits, and recommendations of <br />City staff concerning the application, denied the application; and <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the <br />applicant submitted an appeal of the decision of the Planning Commission; and <br />WHEREAS, at its meeting of January 15, 2008, the City Council received a <br />report from the Director of Planning and Community Development, together with a copy <br />of the staff report to the Planning Commission, regarding this matter; and <br />WHEREAS, the City Council held a public hearing on January 15, 2008, at which <br />time the applicant and any other members of the public were offered an opportunity to <br />present evidence regarding this appeal; and <br />WHEREAS, after a review of the materials presented, the City Council <br />determined that the proposed animal use, as conditioned, is appropriate for the site and <br />is consistent with the zoning regulations of the zoning district of the property. <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br />CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER <br />THE FOLLOWING: <br />SECTION 1. Approves the appeal, Case PAP-115, thereby approving <br />Case PAUP-4, the application of Jennifer Hosterman for an animal use permit to allow a <br />red-tailed hawk to be kept in an enclosed area in the backyard of an existing residence <br />located at 2922 Chardonnay Drive, subject to the conditions shown on Exhibit B, <br />attached hereto and made a part of this case by reference. <br />SECTION 2. This resolution shall become effective immediately upon its passage <br />and adoption. <br />
