affected portion of the Property being referred to <br />hereinafter as the "Easement Area") and (ii) the right to - <br />enter upon the Property and the Easement Area for the <br />purposes of constructing, installing, servicing and main- <br />taining the Water Lines. The Easement Area is more particu- <br />larly described in Exhibit B, attached hereto and incorpor- <br />ated herein by reference. When constructed and installed, <br />the Water Lines will provide water to the improvements that <br />will be constructed by Prudential (or its successor-in- <br />interest) within the Property. <br /> <br /> NOW, THEREFORE, IN CONSIDERATION of the mutual <br />covenants and promises of the parties, the parties hereto <br />agree as follows: <br /> <br /> 1. Easement. Grantor hereby grants to Grantee a <br />nonexclusive easement ("Easement"), for purposes of con- <br />structing, installing, servicing and maintaining the Water <br />Lines, under the Easement Area. <br /> <br /> 2. Incidental Rights and Duties. <br /> <br /> a. Incidental Rights. Grantee shall have <br /> <br />all rights necessary or incidental to the Easement, <br />including (i) the right to enter upon the Property and the <br />Easement Area in order to repair and maintain the Water <br />Lines and (ii) the right to place (or permit to be placed) <br />workers' supplies and building materials, refuse and debris <br />at or near the site of any construction, installation or <br />other work contemplated by this Agreement. <br /> <br /> 2. <br /> K526-20-S/23Jan87/ <br /> <br /> <br />
