Dear Jeff - <br />According to the Municipal Code Section 18.32.040 - Section K -Conditional use for R1 districts <br />- rabbits and fowl n3quire the conditional use pemnit. Websters defines fowl as 'a bird of any <br />kind.' This is confusing and I understand that confusion needs to be dean3d up by the City. <br />My spedfic concern is the interpretation of referenk~d section 7.36.010 and the safety and well <br />being of children and small pets in the area. I know there are already wild raptors in Pleasanton - <br />but they don't generaly nest in people's bads yards. I would think adjoining neighbors with kids <br />and small pets would have a right to know or say something about a captive bird of prey in dose <br />proximity on a property line. This is not like keeping aparrot or aparakeet -there are razor <br />sharp talons and beaks to be considered - as well as a wild animal trained to kill. This is <br />INDEPENDENT of the owner having the proper federal and state licenses or the owners <br />competency in handling a bird of prey. <br />ff the city needs to make a special exception for birds of prey (as it did for fewer than six chickens <br />on a property) -then the City should seedy that prek~ssely in the municipal code. ff you don't <br />spedfy it predsey or enforoe it precisely, we'll have this Dome up every time some new or exotic <br />pets corns to Pleasanton -especially those that are potentially dangerous if not handled <br />propery. As birds of prey are not explicitly excluded in section 18.32.040 IC,1 assumed <br />that a conditional use permit should and would be required because of ssctlon 7.36.010 <br />urrtil Section 18.32.040 is changed. <br />Thanks for your diligence in this matter. I understand about the training next week and the time it <br />may take to dear this up. Please let me know when you can -and please consider the safety <br />aspect of the neighbors. Better to understand this vary and set the code right or make sure <br />neighbors are informed via the conditional use permit process. <br />Again - if this is a wild goose chase (sorry for the pun) I apologize profusely in advance. I <br />consider it a safety issue.
