~l <br /> <br />t ... <br />1. <br />required as a result of the willful or negligent act o! any such <br />Owner, or its family, contract purchasers, lessees, or tenants, or <br />their licensees, guests, or invitees shall be the responsibility <br />of the Owner to whom the willful or negligent act is attributed. <br />The Owners covenant and agree that no maintenance or repair work <br />shall be done, or caused to be done, in or upon the Driveway <br />Easement Area without first obtaining the written consent of the <br />other Owner. Such consent shall not be unreasonably withheld. If <br />a dispute should arise between the Lot owners with respect to the <br />necessity for or standard of maintenance of the driveway, the <br />contractors to be engaged to perform any repair or maintenance <br />work, or any other matters pertaining to the use or maintenance of <br />the Driveway Easement Areas, the dispute shall be resolved in <br />accordance with Section 845 of the California Civil Code. <br />3.2.3 Additional Easements: Notwithstanding anything <br />expressed or implied to the contrary, this Declaration shall bs <br />subject to all easements granted by Declarant for the installation <br />and maintenance of utilities and drainage facilities necessary for <br />the development of the Project. <br />3.2.4 Storm Drains: There are reserved and granted <br />for the benefit of each Lot, as dominant tenement, over, under, <br />across and through the Project, as the servient tenement, <br />non-exclusive easements for surface and subsurface storm drains and <br />the flow of storm waters in accordance with tie drainage patterns <br />and improvements installed or constructed by Declarant. <br />4.1 USE ,~D OCCUPANCY OF IAT~ AND RESIDENCES: Each Residence <br />shall be used solely for residential purposes. No other use is <br />allowed except as specifically permitted by local ordinance. No <br />Owner may permit or cause anything to be done or kept upon, in or <br />about his Lot which might obstruct or interfere with the rights of <br />other Owners or which would be noxious, harmful or unreasonably <br />offensive to other Owners. Each Owner shall comply with all of the <br />requirements of all governmental authorities, federal, state or <br />local, and all laws, ordinances, rules and regulations applicable <br />to his Lot and Residence. <br />4.2 PARKING: No boat, trailer,. camper, golf cart, <br />commercial vehicle, motor home or other recreational vehicle or-any <br />dilapidated vehicle shall be parked or stored anywhere in the <br />Project except within an enclosed garage. <br />4.3 ,STORAGE OF WASTE MATERIAIS: All garbage, trash and <br />accumulated waste material shall be placed in appropriate covered <br />trash containers or receptacles. <br />4 <br />LITTLE a SAPUTO <br />:1 rroRNers w r tw w <br />.+9 ouAlc covRr. svlrs ~u <br />WALNUT CRBHK.
