ATTACHMENT 6 <br />FINDINGS <br />The Planning Commission needs to make the following findings prior to <br />approving a use permit. These findings must relate to the specific proposal being <br />made. <br />1. The location of the proposed conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in <br />which the site is located. <br />Objectives of the Zoning Ordinance include: fostering a harmonious, convenient, <br />workable relationship among land uses; protecting existing land use from <br />inharmonious influences and harmful intrusions; and ensuring that public and <br />private lands ultimately are used for the purposes which are most appropriate and <br />beneficial to the City as a whole. In the past, the City has allowed similar animal <br />keeping, such as hens, to be located in residential areas. Staff does not feel that <br />the hawk would be disruptive to the neighboring residences. The subject site is <br />located in a PUD, however adheres to the R-1 District standards. The keeping of <br />hawk is a conditionally permitted use in the R-1 District. The applicant's keeping <br />of hawk is incidental to the use of the property as asingle-family residence. This <br />finding can therefore be made. <br />2. The proposed location of the conditional use and the conditions under <br />which the conditional uses would be operated or maintained will not be <br />detrimental to the public health, safety, or welfare, or materially <br />injurious to the properties or improvements in the vicinity. <br />Staff believes that the keeping of the hawk, as conditioned, would not be <br />detrimental to the public health, safety, or welfare, or materially injurious to <br />properties or improvements in the vicinity. The applicant has received all <br />applicable permits from State and/or Federal agencies and would be required to <br />receive all appropriate City permits. The hawk will not be released, whether for <br />hunting or exercise purposes, within the neighborhood or public park areas. The <br />applicant will only release and train the hawk in designated areas. Both the hawk <br />mew and the subject property are well maintained. Therefore, staff does not <br />believe that the keeping of the hawk would be disruptive to adjacent neighbors or <br />the City. <br />For the reasons stated above, staff believes this finding can be made. <br />
