RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON DECLARING A PORTION OF (OLD) VINEYARD AVENUE AS SURPLUS AND ABANDONING THE CITY'S INTEREST THEREIN WHEREAS, On December 18, 2007, the City Council received a staff report declaring approximately 26,260 square feet of (Old) Vineyard Avenue right of way as surplus, which right of way is more particularly described in Exhibit A attached hereto and incorporated herein by reference, and recommending that the City abandon the City's interest therein; and WHEREAS, the portion of (Old) Vineyard Avenue right of way proposed to be abandoned is no longer needed for present or future street use due to the realignment of Vineyard Avenue; and WHEREAS, by abandoning this right of way, access will not be cut off to any property that adjoins the portion of (Old) Vineyard Avenue right of way proposed for abandonment; and WHEREAS, no public service easements are to be terminated as a result of the proposed abandonment. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. Based upon the findings stated above, that portion of (Old) Vineyard Avenue right of way described in Exhibit "A" is hereby declared surplus and is abandoned. SECTION 2. The City Clerk shall record a certified copy of this resolution with the office of the Alameda County Recorder. SECTION 3. This resolution shall become effective upon its passage and adoption. PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on December 18, 2007.
