f. Tenant shall control and limit the growth of undesirable plants <br />(weeds) on the Property. <br />g. Tenant shall keep the Property in good order and condition. <br />Tenant shall not commit, suffer or permit any waste or nuisance on the Property. <br />h. Tenant shall limit the hours of farming activity on the Property to <br />8:00 am to 6:00 pm, Monday through Friday, and 9:00 am to 6:00 pm, Saturday and <br />Sunday. Extended hours or days for planting or harvesting due to weather may be <br />approved by the Parks Maintenance Superintendent. <br />i. Tenant shall comply with all federal, state and local laws and <br />regulations concerning the Property and the use of it, including obtaining and maintaining <br />any required permits or approvals. <br />j. Tenant shall not encumber the Property in any manner whatsoever; <br />nor make any improvements on or alterations to the Property without the prior written <br />approval of the City. <br />k. Tenant shall not cause or permit any laborer's or mechanic's liens <br />or other liens to be attached to the Property. If liens are attached to the Property arising <br />out of Tenant's use of the Property, Tenant shall promptly remove such liens by payment <br />or posting of a statutory release bond and shall pay any costs incurred by the City, <br />including reasonable attorneys' fees. <br />1. Tenant shall permit the City to enter the Property for inspection at <br />any time, and to post any notice on the Property required or permitted by law for <br />protection of any right of interest of the City. <br />m. Tenant shall maintain and repair the fencing, unless the damage is <br />caused by the City or by the public, in which case repairs shall be the City's <br />responsibility. <br />n. Tenant acknowledges that construction activities will be occurring <br />adjacent to the Property, and that construction vehicles will be operating adjacent to the <br />Property. <br />3. Term of Agreement. The term of this Agreement shall begin on January <br />16, 2008 and continue until January 16, 2009, unless otherwise terminated pursuant to the <br />terms of this Agreement. The Agreement shall be renewed automatically for one-year <br />periods, unless terminated by either party prior to December 1 of each year. Tenant <br />acknowledges that the City is considering other long-term uses for the Property, and that <br />this Lease Agreement for farming is considered an interim use. <br />4. Rental Payment. In consideration of this Agreement, within four weeks <br />of the annual harvest but no later than August 1 each year, Tenant shall double disk the <br />2 <br />
