excess of the amount established by Section 1.22.030. Such verification shall be filed <br />with the City Clerk along with each campaign statement required by Section 1.20.030 of <br />this code, and retained for 12 months following the subject election. <br />1.22.050 Violation. <br />Any violation of Chapter 1.22 shall not be subject to penalty or citation. <br />Section 3. For the November 2008 general municipal election, the election <br />period during which expenditures shall be cumulated for candidates and candidates' <br />controlled committees which have taken the voluntary expenditure pledge shall be from <br />the effective date of this ordinance until December 31, 2008. <br />Section 4. The adjustment to the voluntary expenditure limit provided in <br />Subsection 1.22.030.C, above, shall be based on One Dollar ($1.00) per registered <br />voter for the November 2008 general municipal election, with cumulative adjustments <br />thereafter based on the Consumer Price Index table for All Urban Users - U.S. City <br />Average -All Items -Unadjusted percentage change, as published by the U. S. <br />Department of Labor, utilizing November 2008 as the base; or the most similar <br />consumer price index table if that table is no longer available. <br />Section 5. The determination of the number of registered voters provided in <br />Subsections 1.22.030.A and B is set at a specific date to allow persons filing nomination <br />papers to have a fixed and certain voluntary campaign expenditure limit amount. The <br />need for certainty by candidates making the pledge recognizes that persons who may <br />register up to 15 days prior to an election will not be included in the number of voters <br />establishing that limit. <br />Section 6 Pleasanton Municipal Code section 1.20.030.A. Filing of verified <br />campaign statements is amended to read as follows: <br />A. Each candidate for City office and each committee shall file campaign <br />statements. The contributions and expenditures listed therein shall be <br />cumulative for each election. The due dates and the contribution and <br />expenditure periods shall be as provided in article 2, chapter 4, title 9 of the <br />Government Code, beginning with section 84200. In addition, a campaign <br />statement shall be filed four (4) days prior to an election and shall report all <br />contributions received and expenditures made seven (7) days prior to an <br />election. <br />Section 7 A summary of this ordinance shall be published once within <br />fifteen (15) days after its adoption in `The Valley Times," a newspaper of general <br />circulation published in the City of Pleasanton, and the complete ordinance shall be <br />posted for fifteen (15) days in the City Clerk's office within fifteen (15) days after its <br />adoption. <br />
