AMENDMENT NO. 1 <br /> TO <br /> CONTRACT FOR CONSULTANT SERVICES <br /> <br /> THIS AMENDMENT NO. 1 hereby amends the Agreement for <br />Consultant Services made and entered into on February 12, 1985, <br />by and between the CITY OF PLEASANTON, a municipal corporation, <br />(hereinafter "City") and BISSELL & KARN, INC., a California <br />corporation (hereinafter "Consultant"). <br /> <br /> WITNESSETH: <br /> <br /> A. Bissell & Karn, Inc. entered into an agreement with the <br />City to complete the design for Stage 2 of the Hopyard Road/I-580 <br />interchange improvements. <br /> <br /> B. Stage 2 design work consisted of new overcrossing and <br />adjacent approach roadways and was estimated to cost <br />$3,000,000.00. <br /> <br /> C. Subsequent modifications, requested by the City, changed <br />the design plans and cost estimates increased. <br /> <br /> D. The design changes included fast track construction <br />sequencing and a third stage. <br /> <br /> E. Compensation for design changes was requested by <br />Consultant and agreed to by City. <br /> <br /> NOW, THEREFORE, City and Consultant agree to amend Paragraph <br />7 of the original agreement dated February 12, 1985 as follows: <br /> <br /> "7. For the services to be rendered hereunder, the City <br />shall pay Consultant on a time-and-materials basis, but the <br />amount paid for Consultant's services shall not exceed the sum of <br />Four Hundred Eighty-Six Thousand Seven Hundred Ten and 00/100 <br />Dollars ($486,710.00), based on Consultant's current annual <br />compensation and rate schedule attached hereto as Exhibit "B", <br />and incorporated herein by this reference, Partial payment shall <br />be permitted on a monthly basis in proportion to the percentage <br />of work completed, upon receipt of Consultant's invoice and the <br />approval of the Public Works Director as to the percentage <br />completion claimed. Payment shall be made within thirty (30) <br />days of receipt of Consultant's invoice." <br /> <br /> - 1 - <br /> <br /> <br />
