CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 87-42 <br /> <br /> ACCEPTANCE OF WEST LAS POSITAS BOULEVARD SOUNDWALLS, <br /> PROJECT NO. NPID 82-4C, AND APPROVAL OF FINAL PROGRESS <br /> PAYMENT TO TOMAX BUILDING SYSTEMS <br /> <br />WHEREAS, work by Tomax Building Systems on the West Las'Positas <br /> soundwalls, Project No. NPID 82-4C, has been <br /> satisfactorily completed; and <br /> <br />WHEREAS, it is appropriate to authorize the final progress <br /> payment; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The work on the West Las Positas soundwalls is hereby <br /> accepted. <br /> <br />Section 2: The Director of Finance is instructed to prepare a <br /> warrant in the amount of $2,149.56 in favor of Tomax <br /> Building Systems in satisfaction of the final progress <br /> payment for the above-accepted work on Project No. NPID <br /> 82-4C. Ten percent (10%) of the total contract or <br /> $67,075.05 will be retained until thirty (30) days after <br /> filing of the Notice of Completion. <br /> <br />Section 3: The City Attorney is directed to file a Notice of <br /> Completion with the Alameda County Recorder. <br /> <br />Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED FEBRUARY 3, 1987 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Brandes, Butler, Mohr, Wilson and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> ATTEST: <br /> K .
