PLANNING COMMISSION <br />City of Pleasanton <br />RESOLUTION N0. 1400 <br />A RESOLUTION STATING CONFORMITY WITH <br />PLEASANTON GENERAL PLALd FOR DEDICATION <br />OF STREET RIGHT-OF-WAY IN MS 75-13 <br />WE3EREAS, with the approval of MS 75-13 which created the <br />site for Parcel P4ap No. 1820 on Santa Rita Road, the dedication <br />cf certain easements were required by the review committee. <br />Specifically that the owner dedicate to the City of Pleasanton <br />an eight (8) foot public service easement across the Santa Rita <br />Road frontage of this property; and <br />WHEREAS, Government Code Section 95402 (a) required that <br />"If General Plan or part thereof has been adopted, no real <br />property shall be acquired by dedication or otherwise for street, <br />quare, park or other purposes...until the location, purpose <br />nd extent of such acquisition...have been submitted to and <br />eported upon by the planning agency as to conformity with said <br />dopted general plan or part thereof;" and <br />WHEREAS, a plat showing parcels 1, 2 and 3 of Parcel Map <br />820 as well as the parallel easement that has been offered in <br />edication to the City of Pleasanton is attached as Exhibit A; <br />WHEREAS, the road for which dedication of easement is being <br />ffered is shown as a street on the Pleasanton General Plan. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />LEASANTON RESOhVES AS FOLLOWS: <br />Section 1. That the Planning Commission finds conformity <br />etween the General Plan and the offer of dedication and grant <br />f easement. <br />Section 2. This resolution shall become effective imme- <br />iately upon passage and adoption. <br />PASSED AND ADOPTED by the Planning Commission of the City <br />
