CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 87-27 <br /> <br /> RESOLUTION VACATING PORTIONS OF OAKLAND AVENUE <br /> <br />WHEREAS, on January 20, 1987, the City Council received a staff <br /> report recommending the vacation of portions of Oakland <br /> Avenue; more particularly described in plats and <br /> accompanying legal descriptions labeled Exhibit "A" and <br /> Exhibit "B", attached hereto and incorporated herein by <br /> this reference; and <br /> <br />WHEREAS, the proposed vacation of portions of Oakland Avenue is <br /> consistent with the goals and policies of the General <br /> Plan; and <br /> <br />WHEREAS, a portion of Oakland Avenue is no longer necessary for <br /> present or prospective public use, a portion of Oakland <br /> Avenue is excess right-of-way and is not required for <br /> street or highway purposes; and <br /> <br />WHEREAS, there is in place public utility facilities which are in <br /> use, and public convenience and necessity require the <br /> reservation of easements for those utility facilities; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing the <br /> portion of Oakland Avenue is excess right-of-way in a <br /> manner meeting the requirements of Section 8334(a) of <br /> the Streets and Highways Code, those portions of Oakland <br /> Avenue described in Exhibit "A" are hereby vacated. <br /> <br />Section 2: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing the <br /> necessity to reserve the public service easement in a <br /> manner meeting the requirements of Section 8333(c) of <br /> the Streets and Highways Code, those portions of the <br /> public service easement described in Exhibit "B" are <br /> hereby reserved. <br /> <br />Section 3: The Clerk shall cause a certified copy of this <br /> resolution of vacation to be recorded in the Office of <br /> the Alameda County Recorder upon its becoming effective. <br /> <br /> <br />
