CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 87-27 RESOLUTION VACATING PORTIONS OF OAKLAND AVENUE WHEREAS, on January 20, 1987, the City Council received a staff report recommending the vacation of portions of Oakland Avenue; more particularly described in plats and accompanying legal descriptions labeled Exhibit "A" and Exhibit "B", attached hereto and incorporated herein by this reference; and WHEREAS, the proposed vacation of portions of Oakland Avenue is consistent with the goals and policies of the General Plan; and WHEREAS, a portion of Oakland Avenue is no longer necessary for present or prospective public use, a portion of Oakland Avenue is excess right-of-way and is not required for street or highway purposes; and WHEREAS, there is in place public utility facilities which are in use, and public convenience and necessity require the reservation of easements for those utility facilities; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Pursuant to Chapter 4 of the Streets and Highways Code and based upon the findings above establishing the portion of Oakland Avenue is excess right-of-way in a manner meeting the requirements of Section 8334(a) of the Streets and Highways Code, those portions of Oakland Avenue described in Exhibit "A" are hereby vacated. Section 2: Pursuant to Chapter 4 of the Streets and Highways Code and based upon the findings above establishing the necessity to reserve the public service easement in a manner meeting the requirements of Section 8333(c) of the Streets and Highways Code, those portions of the public service easement described in Exhibit "B" are hereby reserved. Section 3: The Clerk shall cause a certified copy of this resolution of vacation to be recorded in the Office of the Alameda County Recorder upon its becoming effective.
