PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 1445 <br />A RESOLUTION OF THE PLANNING COMMISSION OF <br />THE CITY OF PLEASANTON APPROVING A CONDITIONAL <br />USE PERMIT TO ALLOW THE KEEPING AND RAISING <br />OF PIGEONS AND A PHEASANT AT 3386 HARPERS <br />FERRY COURT. <br />WHEREAS, Roger Bailey has applied for a conditional use permit <br />to allow the keeping and raising of pigeons and a <br />pheasant at his residence located at 3386 Harpers <br />Ferry Court; and <br />WHEREAS, zoning for the property is R-1-6500 (Single Family) <br />District; and <br />WHEREAS, a public hearing on this application, with pertinent <br />testimony, documents and maps carefully reviewed by <br />the Planning Commission, was held; and <br />WHEREAS, the Planning Commission made the following findings: <br />A. That the proposed location of the conditional <br />use in a residential area, would be in accord <br />with the objectives of this chapter and the <br />purposes of the district in which the site is <br />located if there is strict compliance with all <br />six conditions listed below; and <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be main- <br />tained will not be detrimental to the public <br />health, safety or welfare or be materially <br />injurious or cause disturbance to properties <br />or improvements in the vicinity; and <br />C. That this conditional use will comply with each <br />of the applicable provisions of this chapter. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Approval of UP-76-24, subject to the following <br />conditions: <br />1. That the number of birds kept on the premises at <br />any one time be limited to 1 pheasant and 12 <br />pigeons and that no more than 2 of the latter <br />birds be homing pigeons. <br />2. That except for the 2 homing pigeons, all birds <br />be kept in their cages at all times. <br />3. That the homing pigeons be allowed to fly no more <br />than one hour per day and that this be done imme- <br />
