PLANNING COMMISSION CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 1445 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON APPROVING A CONDITIONAL USE PERMIT TO ALLOW THE KEEPING AND RAISING OF PIGEONS AND A PHEASANT AT 3386 HARPERS FERRY COURT. WHEREAS, Roger Bailey has applied for a conditional use permit to allow the keeping and raising of pigeons and a pheasant at his residence located at 3386 Harpers Ferry Court; and WHEREAS, zoning for the property is R-1-6500 (Single Family) District; and WHEREAS, a public hearing on this application, with pertinent testimony, documents and maps carefully reviewed by the Planning Commission, was held; and WHEREAS, the Planning Commission made the following findings: A. That the proposed location of the conditional use in a residential area, would be in accord with the objectives of this chapter and the purposes of the district in which the site is located if there is strict compliance with all six conditions listed below; and B. That the proposed location of the conditional use and the conditions under which it would be main- tained will not be detrimental to the public health, safety or welfare or be materially injurious or cause disturbance to properties or improvements in the vicinity; and C. That this conditional use will comply with each of the applicable provisions of this chapter. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1. Approval of UP-76-24, subject to the following conditions: 1. That the number of birds kept on the premises at any one time be limited to 1 pheasant and 12 pigeons and that no more than 2 of the latter birds be homing pigeons. 2. That except for the 2 homing pigeons, all birds be kept in their cages at all times. 3. That the homing pigeons be allowed to fly no more than one hour per day and that this be done imme-
