CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 87-21 <br /> <br /> RESOLUTION VACATING A PORTION OF SANTA RITA ROAD <br /> <br />WHEREAS, on January 20, 1987, the City Council received a staff <br /> report (SR 87:18) recommending the vacation of a portion <br /> of the dedicated street right-of-way for Santa Rita Rod, <br /> more particularly described on Exhibit "A" attached <br /> hereto and incorporated herein by this reference; and <br /> <br />WHEREAS, the excess street right-of-way is not required for <br /> street purposes; and <br /> <br />WHEREAS, public convenience and necessity require the reservation <br /> of an easement for public service over said vacated <br /> land; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing that <br /> the street right-of-way is not required for street <br /> purposes pursuant to Section 8334 of the Streets and <br /> Highways Code, a portion of the street right-of-way for <br /> Santa Rita Road described in Exhibit "A" is hereby <br /> vacated. <br /> <br />Section 2: That public service easement described in Exhibit "A" <br /> and shown on the attached map shall be reserved for a <br /> public service easement. <br /> <br />Section 3: That from and after the date the resolution is <br /> recorded, the street vacated no longer constitutes a <br /> street. <br /> <br />Section 4: The Clerk shall cause a certified copy of this <br /> resolution of vacation to be recorded in the Office of <br /> the Alameda County Recorder upon its becoming effective. <br /> <br /> <br />
