D RAF T <br />CITX COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />ORDINANCE NO. <br />AN ORDINANCE AMENDING SECTION 2-5.04 OF ARTICLE 1- <br />`~ (GENERAL ), CHAPTER 2 (ZONING), TITLE II (ZONING AND <br />DEVELOPMENT) RELATING TO THE APPLICATION OF THE <br />PLEASANTON ZONING CHAPTER <br />?THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES ORDAIN AS FOLLOWS: <br />' Section 1. Section 2-5.04 (Application), Article l; (General), <br />''Chapter 2 (Zoning), Title II (Zoning and Development): is hereby <br />;, <br />'-;amended in its entirety to read as follows: <br />§ 2-5.04 Application. This chapter shall apply to all <br />property owned by private persona, firms, corporations, <br />or organisations except public streets and alleys. It <br />shall also apply to property owned by the City of Pleasan- <br />ton; by any agencies of the City of Pleasanton;-or by <br />any local agency required to comply with this chapter by <br />State law. However, this chapter shall. not apply to <br />property owned by the United States of America or any of_ <br />its agencies; by the State of California or any%bf'ita <br />agencies or political subdivisions not required by State <br />law to comply with the City's Zoning Chapter; or by any <br />city (other than the City of Pleasanton}, county or, <br />',s rapid transit district. All exempted agencies are urged to <br />submit their proposed projects to the permit and review .pro <br />cedures set forth in this chapter and to cooperate in <br />meeting the goals and objectives of this.code.and the <br />Pleasanton General Plan. <br />This chapter shall apply to structures and s gne extending <br />into or above streets or alleys, to railroad-rights.-of-way, <br />to electric and communications distribution and service <br />wires where prescribed in the district ,regulations; " <br />provided, however, that the routes or proposed electric or <br />gas transmission lines shall be submitted to the Planning <br />Commission for approval prior to the acquisition of right- <br />. of-way thereof. Upon review of the utility company's <br />application and the Planning Director's proposed conditions <br />for route approval, the Planning Commission may set a <br />public hearing for purposes of considering alternate <br />routes, or modifying any conditions vital to. the public <br />interest, which. in the opinion of the Planning Commission <br />requires a public hearing. <br />'±Section 2. This ordinance shall become effective thirty (30 <br />'.days after its passage and adoption.. <br />;Section 3. This ordinance shall be published once within fifteen <br />(15) days after its adoption in "THE TIMES," a newspaper of <br />;general circulation, published and. circulated in the Gty of` <br />=Pleasanton. <br />-1- <br />
