CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 87-13 <br /> <br /> RESOLUTION APPROVING CITY UNDERTAKING MAINTENANCE WORK <br /> ASSOCIATED WITH TWELVE OAKS AND BILLING UPPER TWELVE <br /> OAKS HOMEOWNERS ASSOCIATION FOR THE WORK <br /> <br />WHEREAS, at its meeting of January 6, 1987, the City Council <br /> reviewed the report (SR 87:21) regarding the drainage <br /> problem in the Twelve Oaks development which included <br /> various alternatives; and <br /> <br />WHEREAS, testimony was taken from various interested parties <br /> regarding the possible solutions to the problem; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Approves Alternative 2 of Staff Report 87:21 <br /> directing City staff to undertake the maintenance work <br /> associated with Twelve Oaks and bill the Upper Twelve <br /> Oaks Homeowners Association for the cost. <br /> <br />Section 2: Authorizes the emergency work to be undertaken on the <br /> basis of quotes rather than formal bids in accordance <br /> with Public Contracts Code Section 20168. <br /> <br />Section 3: It is hereby stated that the city involvement is <br /> based upon the emergency circumstance and is not <br /> intended to set a precedent. <br /> <br />Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED JANUARY 6, 1987 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Brandes, Mohr, Wilson and Mayor Mercer <br />NOES: Councilmember Butler <br />ABSENT: None <br />ABSTAIN: None <br /> <br />ATTEST: <br /> KEMNE~H ~f~ERCER, MAYOR <br /> <br /> By Doris George, Deputy City Clerk <br /> <br /> A ROVED AS TO FORM: <br /> <br /> 1 <br /> P~t~r D'.
