PLANNING COMMISSION City of Pleasanton RESOLUTION NO. 1343 A resolution of the Planning Commission of the City of Pleasanton approving UP-75-11. WHEREAS, the application of Lynnewood United Methodist Church for a conditional use permit to con- tinue to operate a 72-student nursery school on the church property at 4444 Black Avenue; zoning for the property being P (Public and Institutional) District, has come before this Commission, and WHEREAS, the Planning Commission has held a public hearing on this application and has examined pertinent maps, drawings and documents and has made the following findings: a. That the proposed location of the con- ditional use is in accord with the objectives of this chapter and the purposes of the dis- trict in which the site is located. b. That the proposed location of the con- ditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. c. That the proposed conditional use will comply with each of the applicable provisions of this chapter. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission approves UP-75-11, subject to the following conditions: 1. That the nursery school shall accommodate a maximum of 72 children and that school activities be carried out in the existing fenced play yard area and the sanctuary building. If, as the church develops, in- creased area is desired for the school, that a new conditional use permit must be requested. 2. That the church complete a landscape rehabilitation program incorporating land- scaping in accordance with the landscaped plan, Exhibit A, approved by the Design Review Board, as part of case Z-72-62, and that said program be completed by September 15, 1975. 3. That the new operator of the nursery school secure all state and county licenses and certificates required for the operation of a nursery school.
