WHEREAS, at the conclusion of this hearing, the Planning Com- <br />mission deliberated on the material submitted to it <br />and the testimony of witnesses; <br />NOW, THEREFORE, the Planning Commission of the City of Pleasanton <br />RESOLVES AS FOLLOWS: <br />Section 1. The requested modification to Section 2-3.40 of <br />Article 7, Chapter 1, Title II of the Ordinance Code <br />for the establishment of a private street as opposed <br />to a public street is hereby denied for the following <br />reasons: <br />(1) The proposed design does not contain or attempt <br />to provide safety devices such as guard rails, <br />vehicular runaway ramps, or vehicular turn outs. <br />(2) An 18-foot wide travel lane is too narrow to safely <br />accommodate two-way vehicular traffic on a hill- <br />side having a continuous slope of 20% for a <br />distance of approximately 1700 feet. <br />(3) The design of the roadway as proposed contains <br />inadequate drainage provisions to prevent runoff <br />from the adjacent hillsides from causing debris <br />to build up on the roadway, thus presenting a <br />safety hazard. <br />(4) No good, sufficient and adequate justification has <br />been submitted for imposing upon ten individual <br />property owners the obligation for maintaining, <br />repairing and improving a road with the length and <br />grade shown on Tentative Map #3256. <br />(5) There has been no demonstrated benefit which would <br />accrue to the City by making the proposed road a <br />private road. <br />(6) The private roads which have been approved in the <br />past by the City have been in conjunction with <br />planned unit developments or multi-family develop- <br />ments where the private street serves the function <br />of a private driveway and there was easy and con- <br />venient access to a public street. In addition, <br />developments with private driveways have all been <br />constructed on relatively flat land and not on any <br />property with a length and grade comparable to the <br />proposed 1700 feet of 20% grade on Tentative Map <br />#3256. <br />Section 2. The requested modifications of Section 2-4.01, Artic <br />7, Chapter 1, Title II of the Ordinance Code to allow <br />the construction of homes on lots not having 35 feet <br />of street frontage would be favorably considered by the <br />-2- <br />
