PLANNING COMMISSION
City of Pleasanton
RESOLUTION NO. 1399
A RESOLUTION FINDING CONFORMITY WITH
GENERAL PLAN OF PROPOSED QUITCLAIM
OF PROPERTY TO DUKE BONDE.
WHEREAS, in 1955, a 1.0 acre site was acquired from Mr. Duke
Bonde easterly of the upper end of Abbie Street for the siting
of a water reservoir to serve the Pleasanton Heights area. As
development occurred in the Vintage Hills area, the water
reservoir previously constructed became inadequate to serve the
area and a new, larger reservoir had to be constructed. At that
time, Mr. Bonde did not desire to sell any more of his property
but agreed to a new configuration for the one acre previously
lacquired that would accommodate the location of the new reservoir.
This new site partially overlapped the old site and the new
site was deeded to the City with the understanding that the
remainder of the old site would be quitclaimed to Mr. Bonde. To
comply with this understanding, it is now necessary to quitclaim
this remainder to Mr. Bonde; and
WHEREAS, Government Code Section 95402(a) requires that
"If a General Plan or part thereof has been adopted, ... no real
property shall be disposed of ... until the location, purpose
and extent of such ... disposition ... have been submitted to
and reported upon by the planning agency as to conformity with
said adopted general plan. ... "; and
WHEREAS, the Bonde reservoir site is shown on the General
Plan as open space, but it is the City's intent to allow public
utilities of this type in the open space district once the open
space ordinance is developed.
