CONTRACT AGREEMENT BETWEEN THE CITY OF PLEASANTON <br /> AND THE <br /> COUNTY OF ALAMEDA <br /> FOR <br /> ADDITIONAL LIBRARY SERVICES <br /> <br /> INTENT <br /> <br /> WHEREAS, current funding level for County Library services prevent <br /> increasing the number of open hours per week at the Pleasanton Branch of the <br /> Alameda County Library System, and <br /> <br /> WHEREAS, the citizens of Pleasanton wish to have the Pleasanton <br /> Branch Library open more than the current 35 hours per week, and <br /> <br /> WHEREAS, the members of the Pleasanton City Council have authorized <br /> funding for the increases in staffing and utility costs required to open the <br /> Pleasanton Branch seven (7) additional hours for a total of 42 open hours per <br /> week; therefore, <br /> <br /> The City of Pleasanton and the County of Alameda agree to provide seven (7) <br /> additional hours per week of library services at the Pleasanton Branch of the <br /> Alameda County Library System subject to the following terms and conditions. <br /> <br /> TERMS AND CONDITIONS <br /> <br />l) Effective Dates: This contract will be in effect from July 1, 1987 <br /> to June 30, 1988. <br /> <br />2) Services Described: The County of Alameda agrees to provide seven <br /> (7) additional hours of Library Services at the Pleasanton Branch <br /> Library each Monday, excluding County observed holidays, from 10:00 <br /> a.m. to 5:00 p.m. <br /> <br />3) Payments: The City of Pleasanton agrees to pay the County of <br /> Alameda $42,654 in four (4) quarterly installments as follows: <br /> <br /> September 30, 1987 - $10,663.50 <br /> December 31, 1987 - $10,663.50 <br /> March 31, 1988 - $10,663.50 <br /> June 30, 1988 $10,663.50 <br /> <br />4) Extension: All terms and conditions of this contract may be <br /> extended, by mutual agreement, on a year-to-year basis, provided <br /> the amount paid by the City of Pleasanton to the County of Alameda <br /> is adjusted annually to reflect increases/decreases to the costs <br /> connected with providing the services. <br /> <br />5) Periodic Activity Reports: Activity Reports will be provided by <br /> the County Librarian to the Pleasanton City Council. Pleasanton <br /> City Council may request such reports at any time. <br /> <br />6) Mid-Year Adjustments: The cost of providing seven (7) additional <br /> hours of library service is based on a projected salary increase of <br /> 4%. Should salary increases be higher than anticipated as a result <br /> of negotiations to be undertaken for FY 87/88, or as a result of <br /> pay equity adjustments, the County Librarian may return to the <br /> Pleasanton City Council to negotiate a mid-year funding adjustment <br /> to pay for personnel costs. <br /> <br />7) Option to Terminate or Rene~otiate Contract: This contract is <br /> predicated on the assumption that library service levels will <br /> remain constant. Should any circumstance arise which changes both <br /> County Library funding levels and levels of service, either party <br /> shall have the right to terminate or renegotiate this agreement by <br /> giving at least thirty (30) days written notice. <br /> <br />8) Liability: <br /> <br /> a) All persons employed in the performance of such services and <br /> functions for City of Pleasanton shall be County employees, and no <br /> City employees as such shall be taken over by the County and no <br /> person hereunder shall have any City pension, Civic Service, or <br /> other status or right. <br /> <br /> <br />
