PCUP-165 <br />Home Depot <br />Exhibit C, Final Conditions of Approval <br />City Council <br />December 4, 2007 <br />1. This conditional use permit for Home Depot will lapse within one year from the <br />date of approval unless a building permit is issued and construction has <br />commenced and is diligently pursued toward completion or the City has <br />approved an extension. <br />2. Home Depot shall be subject to the following operating requirements: <br />a. Operating Hours: <br />The Home Depot shall be open for customers no earlier than 6:00 a.m. to <br />no later than 10:00 p.m. Stocking, restocking, and cleaning the store are <br />allowed between 10:00 p.m. and 6:00 a.m. Parking lot cleaning and <br />sweeping shall not occur between the hours of 10:00 p.m. and 6:00 a.m. <br />b. Shopping Carts: <br />Home Depot employees shall continuously monitor the development's <br />parking areas to ensure that its shopping carts are stored in the <br />enclosures shown on the plan set. <br />c. Seasonal Sales: <br />Four seasonal sales events may take place in the 10,000 square-foot area <br />designated on the site plan. The seasonal sales shall be limited to <br />Christmas tree sales from the week before Thanksgiving through the <br />Christmas season for a total of six calendar weeks, and three other <br />seasonal sale events for no more than two calendar weeks per event. <br />Each season sale shall be reviewed by the Planning Director for <br />conformance with the standards of Section 18.116.040 (Temporary Uses) <br />of the Pleasanton Municipal Code. No other seasonal sales and/or <br />shopping center events are permitted in the parking areas of this <br />development. The seasonal sales area shall not encroach into the <br />emergency vehicle access area near the garden center or the south <br />perimeter driveway. <br />d. Propane Exchange: <br />A propane cylinder exchange program area may take place at the Home <br />Depot upon approval of the Livermore-Pleasanton Fire Department <br />(LPFD). Propane is classified as a hazardous substance and is regulated <br />by the LPFD through its hazardous materials storage and handling permit <br />issued for this development. <br />Page 1 of 3 <br />
