• Since other city streets, such as Santa Rita Rd. and Valley Ave., are not <br />designated trucks routes, no commercial vehicle (over three tons) is permitted to <br />use those streets. Under the City's traffic regulations, an exception to this <br />prohibition on city streets is if such a truck over three tons had already made a <br />delivery in the city via a legal route and then needed to make a delivery at this <br />shopping center. In that case, the truck would be allowed to get to the center by <br />the most direct route available, including Valley Avenue. <br />In addition, staff is working with the applicant and the owners of EI Charro Rd., a private <br />street owned by Legacy Partners and Vulcan Materials, to allow Regency's delivery <br />trucks (coming from the west) to use EI Charro Rd as an alternative. This would provide <br />another option to Rt. 84 and Stanley Blvd. for delivery trucks serving the shopping <br />center. <br />Staff believes that this clarified condition would be much more practical and <br />enforceable, would keep the biggest trucks off city streets, would allow the use of the <br />City's designated truck route for commercial vehicles which are not "delivery trucks", <br />would allow small trucks to use city arterials, and would not shift all delivery trucks onto <br />Livermore streets. <br />Staff has also clarified the restrictions on delivery hours so that the trucks would not be <br />using local streets or loading/unloading during sensitive hours. These restrictions would <br />include the following: <br />• No delivery vehicles of any type would be allowed to enter the site and/or be <br />allowed to load/unload on weekdays between the hours of 10:00 p.m. and 6:00 <br />a.m.; <br />• No delivery vehicles of any type would be allowed to enter the site on weekdays <br />between the peak hours of 7:00 a.m. and 9:00 a.m. and between 4:00 p.m. and <br />6:00 p.m.; <br />• No delivery vehicles of any type and/or no loading/unloading of any delivery <br />vehicles would be allowed on weekends beginning at 8:00 p.m. on Friday <br />evening until 6:00 a.m. on Monday. <br />The applicant has agreed with these conditions. <br />Fnfnrramant <br />Concerns were expressed at the community workshop regarding enforcement of the <br />conditions of approval, especially with regard to the required truck routes, delivery <br />requirements, and other operational issues. Staff is aware that other communities have <br />experienced enforcement problems with Home Depot, and we have considered these <br />issues in creating an enforcement plan best suited for this project. <br />Due to concerns with truck delivery traffic, staff has focused on ways to achieve <br />compliance should the project be approved and constructed. While staff has reviewed <br />the enforcement situations in other communities, we have tried to develop a plan which <br />Page 9 of 14 <br />
