CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 87-306 <br /> <br /> RESOLUTION AUTHORIZING SETTLEMENT OF LITIGATION (CITY <br /> VS. MCI, ET AL.) <br /> <br />WHEREAS, at its meeting of July 21, 1987, Council received the <br /> report of the Assistant City Attorney (SR 87:308) <br /> regarding settlement of the action for reimbursement of <br /> damages caused by the flooding of the Bernal Avenue <br /> underpass; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Authorizes settlement of the litigation City of <br /> Pleasanton v. MCI Telecommunications Corp., et al., <br /> Action No. C-14164, for the sum of $11,000.00. <br /> <br />Section 2: Authorizes the Mayor to execute all documents <br /> necessary to implement the above settlement. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED JULY 21, 1987 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Brandes, Mohr, Wilson and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Butler ~N~~O <br />ABSTAIN: None <br /> <br />ATTEST: <br /> <br /> · , R <br /> <br />By Doris George, Deputy City Clerk <br />~et~~onald~y <br /> <br /> <br />
