jurisdiction. As an alternative, the Building and Safety Official or other employee or
<br />official of the City of Pleasanton as designated by the governing body may institute
<br />other appropriate action to prevent, restrain, correct or abate the violation.
<br />203A.1 Substandard buildings.
<br />All buildings or portions thereof which are determined to be substandard as defined in
<br />Section 1001 of the Housing Code are declared to be public nuisances and may be
<br />abated by repair, rehabilitation, demolition, or removal in accordance with the procedure
<br />specified in Chapter 7.52 of this title or by any other remedy available at law. It shall be
<br />unlawful to maintain or use any such substandard building. Except that any condition
<br />which would require displacement of sound walls or ceilings to meet height, length, or
<br />width requirements of ceilings, rooms, and dwellings shall not by itself be considered
<br />sufficient existence of dangerous conditions making a substandard building, unless the
<br />building was constructed, altered or converted in violation of such requirements in effect
<br />at the time of construction, alteration or conversion.
<br />203A.2 Illegal buildings, structures or installations.
<br />A. Every building or structure or portion thereof, and every electrical, plumbing or
<br />mechanical installation or portion thereof, erected, installed, constructed, enlarged,
<br />altered, repaired, moved, converted, or improved without a permit and which was
<br />subject to the requirements for permits by the California Building Code as adopted by
<br />the City of Pleasanton is declared to be an illegal building, structure or installation. All
<br />illegal buildings, structures or installations shall be made to conform to the provisions of
<br />this chapter or shall be demolished and removed as may be required by the Building
<br />and Safety Official.
<br />B. Whenever necessary to assure compliance with the foregoing provisions, the owner
<br />of any illegal building, structure or installation shall uncover any concealed portions of
<br />such building, structure, electrical, plumbing, or mechanical installation for inspection
<br />and shall perform such tests as may be required by the Building and Safety Official.
<br />C. It is unlawful to use or maintain any illegal buildings, structure or installation or
<br />portion thereof which was erected, installed, constructed, enlarged, altered, repaired,
<br />moved, converted, or improved without a permit.
<br />D. All illegal buildings, structures or installations or portions thereof may be abated by
<br />being made to conform to the provisions of this chapter or by demolition and remove in
<br />accordance with the provisions specified by any remedy available at law.
<br />203A.3 Emergency Measures
<br />1. Eminent danger. When, in the opinion of the code official, there is imminent danger
<br />of failure or collapse of a building that endangers life, or when any building or part of a
<br />building has fallen and life is endangered by the occupation of the building, or when
<br />there is actual or potential danger to the building occupants or those in the proximity of
<br />any structure because of explosives, explosive fumes or vapors, or the presence of
<br />toxic fumes, gases, or materials, or operation of defective or dangerous equipment, the
