CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 87-292 A RESOLUTION OF NECESSITY TO ACQUIRE BY EMINENT DOMAIN PROPERTY NEEDED FOR THE CONSTRUCTION OF THE SYCAMORE WATER RESERVOIR WHEREAS, in analyzing the existing and future water needs of the City of Pleasanton, the City of Pleasanton has engineered and planned an eight million gallon water reservoir and associated transmission line; and WHEREAS, the water needs of the City require acquisition of private property for the construction of the Sycamore Water Reservoir and associated transmission pipeline; and WHEREAS, a detailed plan has been prepared by the City which will allow temporary construction easements in order to minimize impacts upon existing uses; and WHEREAS, notice was given pursuant to Section 1245.235 of the Code of Civil Procedure of the State of California and a hearing was held at which time persons affected had an opportunity to appear and be heard; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The City Council finds that, pursuant to Section 37350.5 of the Government Code of the State of California authorizing the City of Pleasanton to acquire property by eminent domain, all that land described in Exhibit "A", attached hereto, is necessary for public use as a water reservoir and associated transmission line. Section 2: The City Council declares that, with respect to the proposed construction of the Sycamore Water Reservoir, it has found and determined that: (a) the public interest and necessity require the proposed project; (b) the proposed project is planned and located in the manner that will be most compatible with the greatest public good and the least private injury; and (c) the property described in this resolution is necessary for the proposed project.
