CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 87-292 <br /> <br /> A RESOLUTION OF NECESSITY TO ACQUIRE BY EMINENT DOMAIN <br /> PROPERTY NEEDED FOR THE CONSTRUCTION OF THE SYCAMORE <br /> WATER RESERVOIR <br /> <br />WHEREAS, in analyzing the existing and future water needs of the <br /> City of Pleasanton, the City of Pleasanton has <br /> engineered and planned an eight million gallon water <br /> reservoir and associated transmission line; and <br /> <br />WHEREAS, the water needs of the City require acquisition of <br /> private property for the construction of the Sycamore <br /> Water Reservoir and associated transmission pipeline; <br /> and <br /> <br />WHEREAS, a detailed plan has been prepared by the City which will <br /> allow temporary construction easements in order to <br /> minimize impacts upon existing uses; and <br /> <br />WHEREAS, notice was given pursuant to Section 1245.235 of the <br /> Code of Civil Procedure of the State of California and a <br /> hearing was held at which time persons affected had an <br /> opportunity to appear and be heard; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Council finds that, pursuant to Section <br /> 37350.5 of the Government Code of the State of <br /> California authorizing the City of Pleasanton to acquire <br /> property by eminent domain, all that land described in <br /> Exhibit "A", attached hereto, is necessary for public <br /> use as a water reservoir and associated transmission <br /> line. <br /> <br />Section 2: The City Council declares that, with respect to the <br /> proposed construction of the Sycamore Water Reservoir, <br /> it has found and determined that: <br /> <br /> (a) the public interest and necessity require the <br /> proposed project; <br /> <br /> (b) the proposed project is planned and located in the <br /> manner that will be most compatible with the <br /> greatest public good and the least private injury; <br /> and <br /> <br /> (c) the property described in this resolution is <br /> necessary for the proposed project. <br /> <br /> <br />
