CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 87-288 <br /> <br /> APPROVAL OF JOINDER OF CITY OF PLEASANTON IN ACTION BY <br /> LAVWMA AGAINST PIOMBO CORPORATION, ET AL. <br /> <br />WHEREAS, on December 12, 1985, Piombo Corporation punctured the <br /> LAVWMA pipeline while digging piers for the 1-580 <br /> expansion; and <br /> <br />WHEREAS, the LAVWMA Board requested that each of the cities that <br /> are members of the agency join in the action for <br /> recovery of repair costs, since each of the cities <br /> provide funding for LAVWMA; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Authorizes the City of Pleasanton to join in the <br /> LAVWMA lawsuit against Piombo Corporation. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED JULY 7, 1987 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Brandes, Mohr, Wilson and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Butler <br />ABSTAIN: None ~~ <br />ATTEST: <br /> K~NN~TH R.
