ORDINANCE NO. 1963 <br />AN ORDINANCE APPROVING THE APPLICATION OF MIKE CAREY AND <br />STEVE MAESTAS FOR PUD REZONING AND DEVELOPMENT PLAN <br />APPROVAL, AS FILED UNDER CASE PUD-55 <br />WHEREAS, Mike Carey and Steve Maestas have applied for PUD rezoning and <br />development plan approval to rezone an approximately 0.24-acre parcel from RM-1,500 <br />(Multiple-Family Residential) District and Core Area Overlay District to PUD-HDR <br />(Planned Unit Development -High Density Residential) District and to demolish two <br />existing residential units, renovate on existing residential unit, and construct four new <br />single-family homes for a total of five residential units at the property located at <br />225 West Angela Street; and <br />WHEREAS, an Environmental Impact Report (EIR) for the Downtown Specific <br />Plan was certified by the City Council in December 2001; and the EIR anticipated that a <br />high-density residential project would be located on the project site; further, the <br />California Environmental Quality Act (CEQA) specifies that individual residential <br />development projects that are prepared pursuant to the requirements of an adopted <br />specific plan for which an EIR has been prepared and certified are exempt from <br />environmental review; and <br />WHEREAS, at its meeting of October 16, 2007, the City Council received the <br />Planning Commission's positive recommendations for approval of the PUD rezoning <br />and development plan; and <br />WHEREAS, a duly noticed public hearing was held on October 16, 2007; and <br />WHEREAS, after a review of the materials presented, the City Council <br />determined that the proposed rezoning is appropriate for the site; and <br />WHEREAS, the City Council finds that the PUD development plan is consistent <br />with the General Plan and the purposes of the PUD ordinance. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br />SECTION 1. Approves the rezoning of an approximately 0.24-acre parcel <br />located at 225 West Angela Street from RM-1,500 (Multiple-Family Residential) District <br />and Core Area Overlay District to PUD-HDR (Planned Unit Development -High Density <br />Residential) District . <br />SECTION 2. The Zoning Map of the City of Pleasanton, dated April 18, 1960, on <br />file with the City Clerk, designating and dividing the City into zoning districts, is hereby <br />amended by Zoning Unit Map No. 469, attached hereto as Exhibit A, dated October 16, <br />2007, and incorporated herein by this reference. <br />
