-2- <br />authorized to enter the Property and perform such work as it considers reason- <br />ably necessary and proper to maintain and/or restore the landscaping and/or the <br />lighting. The City may act either through its own employees or through an inde- <br />pendent contractor. <br />When the City has completed the work undertaken to maintain the landscap- <br />ing, Property Owner shall pay the full amount of the cost of the work, plus in- <br />terest at the legal rate then payable in the State of California. This interest <br />shall begin to accrue thirty (30) days after Property Owner receives notice of <br />completion of the work and an itemized statement of the charges for the work. <br />4. City's Remedies. The City may bring legal action to collect payment <br />of expenses incurred by City resulting from action undertaken pursuant to Sec- <br />tion 3, or the City may bring legal action for specific performance of the du- <br />ties agreed to by the Property Owner herein. The Property Owner agrees that <br />if the City prevails in any. legal action necessary to enfoYCe this agreement, <br />Property Owner will pay the City a reasonable sum for attorneys' fees and court <br />costs. <br />5. Notices. Unless otherwise provided herein, any notice or communica- <br />tion required under this agreement shall be given in writing and sent by ordin- <br />ary mail to the following address: <br />City: City of Pleasanton <br />P. 0. Box 520 <br />200 Bernal Avenue <br />Pleasanton, California 94566 <br />Attention: City Attorney <br />Property Owner: Trammell Crow Company <br />2180 Sand Hill Road <br />Menlo Park, California 94025 <br />Attention: Peter H. Schnugg <br />Any party or successor in interest may change the foregoing addresses by <br />giving written notice of a new address to each other party. Notice shall be <br />considered received two (2) days after the time of mailing. <br />6. Miscellaneous Terms and Provisions. <br />a. If any provision of this Agreement is judged invalid, the remain- <br />ing provisions of it are not affected. <br />b. This writing contains a full, final and exclusive statement of <br />the agreement of the parties. <br />7. Covenant Running With The Land. This Agreement shall be a covenant <br />which is to run with the land and be binding upon the heirs, successors and <br />assigns of the parties hereto and may be recorded in the Office of the Recorder <br />of Alameda County. <br />In witness whereof, the parties have executed this agreement on the day <br />and year written above. <br />
