Subject to the foregoing, the Property shall <br />hereafter be held, transferred, sold, leased, conveyed and <br />occupied subject to or benefitted by the easements, covenants, <br />and obligations set forth herein, which shall run with the land. <br /> <br /> ARTICLE VIII <br /> <br /> DEDICATION <br /> <br /> Nothing contained in this Agreement shall be deemed to <br />be a gift or dedication of the Recreation Easement to the <br />general public or for the general public or for any public <br />purpose whatsoever, it being the intention of the parties that <br />this Agreement shall be strictly limited to and for the <br />purposes expressed herein, provided that nothing contained <br />herein shall preclude such dedication in the future. <br /> <br /> ARTICLE IX <br /> <br /> ATTORNEYS' FEES <br /> <br /> In the event of any controversy, claim or dispute <br />relating to this Agreement, between the parties hereto to <br />enforce any of the provisions of this Agreement or any right of <br />either party hereto, the prevailing party shall be entitled to <br />recover reasonable attorneys' fees.
