CONTRACT FOR CONSULTANT SERVICES <br /> <br /> PLEASANTON AQUATIC CENTER MODIFICATIONS <br /> <br /> THIS AGREEMENT is made and entered into this day of <br /> , by and between the CITY OF PLEASANTON, a <br />municipal corporation (hereafter referred to as "City"), and <br />MILTON F. JOHNSON ARCHITECT & ASSOCIATES, (hereinafter referred <br />to as "Consultant"). <br /> <br /> WITNESSETH: <br /> <br /> A. Consultant is qualified to provide, and experienced in <br />providing, pool design services and has offered its services for <br />the purposes specified in this Agreement. <br /> <br /> B. In the judgment of the City, it is necessary and <br />advisable to employ the services of Consultant for the purpose of <br />undertaking their design services. <br /> <br /> NOW THEREFORE, in consideration of the mutual covenants, <br />agreements and conditions contained herein, City and Consultant <br />agree as follows: <br /> <br /> 1. Consultant's Services. Consultant <br />shall diligently perform the services and furnish the materials, <br />reports, and so forth as hereinafter set forth: <br /> <br /> a. Consultant shall perform all work described in <br /> Exhibit "A", Scope of Work, attached hereto and <br /> incorporated herein by this reference. <br /> <br /> b. Consultant shall meet with the technical staff of <br /> the City, other pertinent individuals as necessary <br /> to complete the scope of work outlined in Section <br /> l(a) herein. <br /> <br /> 2. Sufficiency of Consultant's Work. Consultant agrees <br />that all reports, etc. prepared for City shall be adequate and <br />sufficient to meet the purposes for which they are performed. <br /> <br /> 3. Ownership of Work. All reports, work data, and all <br />other documents completed or partially completed by Consultant in <br />the performance of this Agreement shall become the property of <br />City. <br /> <br /> 4. Term. The work as described in Exhibit "A", Scope of <br />Work, shall be completed within eight (8) weeks from date of <br />authorization by City to begin work. <br /> <br /> 5. Compensation. For the services to be rendered <br />hereunder, City shall pay Consultant on a time-and-material <br />basis, in an amount not to exceed Seven Thousand Nnine Hundred <br />Dollars ($7,900).
