CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 87-212 RESOLUTION SUPPORTING THE USE OF AMERICAN RIVER WATER TO PRESERVE A HIGH QUALITY WATER SUPPLY WHEREAS, the East Bay Municipal Utility District (EBMUD) signed a contract with the Bureau of Reclamation in 1970 for delivery of 150,000 acre feet of water annually from the American River; and WHEREAS, a lawsuit was filed in court fifteen years ago seeking to prevent EBMUD from diverting water from the American River at the Folsom South Canal; and WHEREAS, the Court appointed the State Water Resources Control Board (SWRB) as its referee and a February 1987 Draft Referee report made the following findings: * American River water would provide the best water quality and pose the least public health risk than any other alternative. , There is no alternative clearly superior to EBMUD's proposal. , Water rights contracts for municipal water should not be modified or set aside without good cause and EBMUD's proposed use of the American River water is reasonable. * That even with conservation measures studies have determined that a need exists for additional water to serve more than one million customers in Alameda and Contra Costa counties to offset deficiencies during drought years and to meet future demands. WHEREAS, the report contains new guarantees that assure the benefits now enjoyed by residents of Sacramento are not diminished; and WHEREAS, the Board staff report demonstrated confidence in the ability of the District to properly manage its water resources in an efficient and environmentally sound manner; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The City Council of the City of Pleasanton urges the State Water Resources Control Board to adopt its staff report which supports the proposal by EBMUD to make prudent use of the water from the American River thereby
