CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 87-212 <br /> <br /> RESOLUTION SUPPORTING THE USE OF AMERICAN <br /> RIVER WATER TO PRESERVE A HIGH QUALITY WATER <br /> SUPPLY <br /> <br />WHEREAS, the East Bay Municipal Utility District (EBMUD) signed a <br /> contract with the Bureau of Reclamation in 1970 for <br /> delivery of 150,000 acre feet of water annually from the <br /> American River; and <br /> <br />WHEREAS, a lawsuit was filed in court fifteen years ago seeking <br /> to prevent EBMUD from diverting water from the American <br /> River at the Folsom South Canal; and <br /> <br />WHEREAS, the Court appointed the State Water Resources Control <br /> Board (SWRB) as its referee and a February 1987 Draft <br /> Referee report made the following findings: <br /> <br /> * American River water would provide the best water <br /> quality and pose the least public health risk than <br /> any other alternative. <br /> , There is no alternative clearly superior to EBMUD's <br /> proposal. <br /> , Water rights contracts for municipal water should not <br /> be modified or set aside without good cause and <br /> EBMUD's proposed use of the American River water is <br /> reasonable. <br /> * That even with conservation measures studies have <br /> determined that a need exists for additional water to <br /> serve more than one million customers in Alameda and <br /> Contra Costa counties to offset deficiencies during <br /> drought years and to meet future demands. <br /> <br />WHEREAS, the report contains new guarantees that assure the <br /> benefits now enjoyed by residents of Sacramento are not <br /> diminished; and <br /> <br />WHEREAS, the Board staff report demonstrated confidence in the <br /> ability of the District to properly manage its water <br /> resources in an efficient and environmentally sound <br /> manner; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Council of the City of Pleasanton urges the <br /> State Water Resources Control Board to adopt its staff <br /> report which supports the proposal by EBMUD to make <br /> prudent use of the water from the American River thereby <br /> <br /> <br />
