BOX 520 PLEASANTON, CA 94566~802 CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 87-208 RESOLUTION VACATING A PORTION OF OLD BERNAL AVENUE STREET RIGHT-OF-WAY WHEREAS, on May 19, 1987, the City 'Council received a staff report (SR 87:218) recommending the vacation of a portion of the street right-of-way for Old Bernal Avenue, more particularly described on Exhibit "A" attached hereto and incorporated herein by this reference; and WHEREAS, th~ excess street right-of-way is not required for street purposes; and WHEREAS, public convenience and necessity require the reservation of an easement for public service over said vacated land; NOW, THEREFORE,. THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Pursuant to Chapter 4 of the Streets and Highways Code and based upon the findings above establishing that the street right-of-way is not required for street purposes pursuant to Section 8334 of the streets and Highways Code, a portion of the street right-of-way for Old Bernal Avenue, described in Exhibit "A", is hereby vacated. Section 2: That public service easement described in Exhibit "A" and shown on the attached map shall be reserved for a public service easement. Section 3: That from and after the date the resolution is recorded, the street vacated no longer constitutes a street. Section 4: The Clerk shall cause a certified copy of this resolution of vacation to be recorded in the Office of the Alameda County Recorder. Section 5: Upon such recordation, the vacation of said portion of Old Bernal Avenue shall be completed. Adopted by Me City Council of
