No. 4-1078-C <br /> <br /> (3) To pay CITY, within 20 days of receipt of CITY's <br />invoice, which invoice may be presented by CITY after completion <br />of STUDY, the actual direct costs for STUDY, up to the amount of <br />$12,000, which amount represents up to $2,000 for each of the six <br />interchange configurations under consideration. STATE's total <br />obligation for said STUDY shall not exceed the amount of $2,000 <br />for each configuration, up to a maximum of $12,000 for' all six <br />configurations. <br /> <br /> SECTION III <br /> <br />IT IS MUTUALLY AGREED AS FOLLOWS: <br /> <br /> (1) All obligations of STATE under the terms of this <br />Agreement are contingent upon the appropriation of resources by <br />the Legislature. <br /> <br /> (2) STATE reserves the right to terminate this Agree- <br />ment upon written notice to CITY. At the time of termination, <br />CITY will be paid for acceptable work accomplished and delivered, <br />in accordance with the terms of this Agreement, The maximum pay- <br />ment to CITY shall not exceed the amounts cited in Article (3) of <br />Section I of this Agreement. Copies of all documents prepared up <br />to the time of termination shall be furnished to and shall become <br />property of the STATE. <br /> <br /> -3- <br /> <br /> <br />
