70. The lot owner/contractor for each custom home site shall arrange and pay for a <br />geotechnical engineer to inspect and approve all building site improvements <br />including, but not limited to, foundations, retaining walls, drainage improvements, <br />NPDES measures to the extent practical, geotechnical mitigations, etc., during <br />construction to ensure that the recommendations have been properly <br />incorporated into the development. The geotechnical engineer or his/her <br />designee shall be on call and shall monitor grading, excavation, and home <br />construction operations. The results of the inspections and the as-built <br />conditions of the project shall be inspected and certified in writing by the <br />geotechnical consultant for conformance to the approved plans and geotechnical <br />report and shall be submitted to the Chief Building and Safety Official for review <br />and approval prior to final inspection. This statement shall appear in the design <br />guidelines. (Mitigation Measure F-2-b of the FEIR) <br />71. The project developer shall create a Geologic Hazard Abatement District (GRAD) <br />for the development covered by this approval. The project developer shall be <br />responsible for preparing all necessary documentation to create the GRAD, <br />including any expenses incurred by the geotechnical engineer for the preparation <br />of the GRAD. The project developer shall be responsible for paying seed money <br />to establish a reserve fund for the GRAD prior to the approval of the final <br />subdivision map, the exact amount of which shall be determined by the City <br />Engineer and City Attorney. Upon recording the final subdivision map for the <br />entire development, or with each phased final subdivision map, the project <br />developer and/or owners of Lots 1 through 51 shall be responsible for paying the <br />future annual GRAD assessments for the development. (Mitigation Measure F-2- <br />c of the FEIR) <br />72. The developed project site -privately-owned and publicly-owned -shall be <br />maintained through an ongoing Slope Management Program (SMP) and a Plan <br />of Control (POC), administered by the Geologic Hazard Abatement District <br />(GRAD). The project developer shall submit the SMP and POC, prepared by an <br />approved geotechnical consulting firm with budgets and assessments funding the <br />GRAD to the City Engineer for review and approval prior to approval of the final <br />subdivision map for this development. (Mitigation Measure F-2-c of the FEIR) <br />Hydrology and Water Quality <br />73. To mitigate the creation of new impervious surfaces that would increase the <br />amount and/or the intensity of runoff, potentially exacerbating existing <br />downstream flooding problems and/or causing hydro modification impacts, the <br />project developer (for the infrastructure) and/or lot owner/contractor (for the <br />individual lots) shall pay the applicable regional drainage fees to the Alameda <br />Water Quality and Flood Control District, Zone 7, at the final map for impervious <br />road surfaces (project developer) and with each building permit for lot <br />development (lot owner/contractor).
