ORDINANCE NO. 1962 <br />AN ORDINANCE APPROVING A DEVELOPMENT AGREEMENT BETWEEN <br />THE CITY OF PLEASANTON AND JENNIFER LIN AND FREDERIC LIN <br />REGARDING THE OAK GROVE DEVELOPMENT <br />WHEREAS, Government Code Section 65865 through Section 65869.5 <br />authorizes cities and counties to enter into binding development agreements with <br />persons having legal or equitable interests in real property for the development of such <br />property; and <br />WHEREAS, James Tong, Charter Properties, has made application to the City <br />on behalf of Jennifer Lin and Frederic Lin for such Development Agreement; and <br />WHEREAS, on October 2, 2007, an Environmental Impact Report prepared for <br />this project was certified as complete and adequate in compliance with the California <br />Environmental Quality Act; and <br />WHEREAS, duly noticed public hearings were held on September 4, 2007 and <br />October 2, 2007. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br />SECTION 1. Finds that the proposed Development Agreement between the City <br />of Pleasanton and Jennifer Lin and Frederic Lin is consistent with the City's <br />General Plan. <br />SECTION 2. Approves the Development Agreement between the City of <br />Pleasanton and Jennifer Lin and Frederic Lin, a copy of which is attached hereto <br />and incorporated herein by this reference, and the final form of which is to be <br />approved by the City Attorney. <br />SECTION 3. The City staff is directed to cause a Notice of Determination to be <br />filed pursuant to Section 5.4(g) of Resolution No. 77-66. <br />SECTION 4. A summary of this ordinance shall be published once within fifteen <br />(15) days after its adoption in `The Valley Times," a newspaper of general <br />circulation published in the City of Pleasanton, and the complete ordinance shall <br />be posted for fifteen (15) days in the City Clerk's office within fifteen (15) days <br />after its adoption <br />SECTION 5. This ordinance shall be effective thirty (30) days after its passage <br />and adoption, provided, however, that if Ordinance No. 1961 is set aside by <br />referendum, this ordinance shall be of no force or effect. <br />
