EXHIBIT B <br />CONDITIONS OF APPROVAL <br />PAP-108, Dennis Long, Robert Leete, and Frank Morgan, Jr. <br />(PADR-1698, Scott and Laurie Smith) <br />3496 Whitehall Court <br />September 26, 2007 <br />1. The proposed development covered by this approval shall conform substantially <br />to Exhibit A, dated "Received, April 27, 2007," on file with the Planning <br />Department, except as modified by the following conditions of approval. Minor <br />changes to the proposal may be approved by the Planning Director if found to be <br />in substantial compliance with the proposal. <br />2. This design approval shall lapse and shall be void sixty (60) days following the <br />effective date of project approval unless prior to the expiration of 60 days, a <br />building permit for the additions totaling 337 square feet per PADR-1698 is <br />issued. <br />3. No design review approval or building permits shall be extended. Should the <br />design review approval or building permit lapse, the additions shall be <br />removed/demolished by the owner; or a new design review application will be <br />required to be submitted to the City. If the applicant fails to comply with the <br />above, staff shall initiate the nuisance abatement process per Section 9.28 of the <br />Pleasanton Municipal Code. <br />4. Within six months from the date the building permit is issued, the applicant shall <br />obtain a building final and complete all exterior and interior work related to <br />PADR-422 (2001 project) and PADR-1698, including but is not limited to all <br />plumbing, electrical, swimming pool, landscaping and irrigation, and all flat work. <br />A final inspection by the Planning Department is required prior to the final <br />inspection by the Building and Safety Division. <br />5. All site improvements and construction activities shall be limited to the hours of <br />8:00 a.m. to 5:00 p.m., Monday through Saturday. In addition, no construction <br />shall be allowed on Federal holidays. If complaints are received regarding the <br />Saturday construction hours, the Planning Director may modify or revoke the <br />Saturday construction hours. The Planning Director may allow earlier "start- <br />times" for specific construction activities (e.g., concrete-foundation/floor pouring), <br />if it can be demonstrated to the satisfaction of the Planning Director that the <br />construction noise and construction traffic noise will not affect nearby residents. <br />All construction equipment must meet DMV noise standards and shall be <br />equipped with muffling devices. <br />
