PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2007-39 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR <br />WALTER FRIEDRICH, PUMP IT UP, AS FILED UNDER CASE PCUP-197 <br />WHEREAS, Walter Friedrich, Pump It Up, has applied for a conditional use permit to <br />operate a children's activity center to be located at 530 Boulder Court; and <br />WHEREAS, zoning for the property is I-G-40,000 (General Industrial) District; and <br />WHEREAS, at its duly noticed public hearing of September 26, 2007, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, existing facilities consisting of the operation, permitting, licensing, or minor <br />alteration of structures involving no expansion of use beyond that existing <br />are categorically exempt (Section 15303, Class 1) from the requirements <br />of the California Environmental Quality Act (CEQA), and this project meets <br />the conditions of the Class 1 exemption; and <br />WHEREAS, the Planning Commission made the following findings: <br />The proposed location of the conditional use is in accordance with the objectives <br />of the zoning ordinance and the purpose of the district in which the site is <br />located. <br />The objectives of the zoning ordinance include fostering a harmonious, convenient, <br />workable relationship among land uses; protecting existing land use from inharmonious <br />influences and harmful intrusions; and ensuring that public and private lands ultimately <br />are used for the purposes which are most appropriate and beneficial to the City as a <br />whole. The proposed use, defined as a recreational facility, is similar in nature to other <br />recreational facilities, such as Diablo Gymnastics, located in close proximity in the <br />Valley Business Park. The proposed facility is not open to the public on a drop-in basis <br />and would be conducted within a building. To ensure a harmonious and workable <br />relationship with other tenants in the proximity, the applicant proposes to provide <br />sufficient on-site parking for parents attending its events and employees of the facility. <br />The applicant imposes strict rules and adequate supervising and monitoring to ensure <br />children's safety. The City has allowed this use to be located in an adjacent building <br />where the existing uses have not changed. There have been no concerns or impacts <br />that Pump It Up has created on surrounding businesses or vice versa. As conditioned, <br />the proposed use would be consistent with these objectives. Therefore, the proposed <br />location of the proposed use is in accordance with the object of the zoning ordinance <br />
