PLANNING COMMISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. PC-2007-37 RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF DON REBER, BRE PROPERTIES, INC., FOR A MODIFICATION TO THE PHASE I AND PHASE II DEVELOPMENT AGREEMENTS FOR HACIENDA BUSINESS PARK AS FILED UNDER CASE PDAM-1 WHEREAS, Don Reber, BRE Properties, Inc., has applied for a modification to the Development Agreements for Hacienda Business Park to extend the Agreements for afive-year period from 2008 to 2013 for nine properties within Phase I and Phase II of the Park; and WHEREAS, zoning for the property is PUD-I/C-O (Planned Unit Development - Industrial/Commercial-Office) District; and WHEREAS, the City Council approved the Phase I Development Agreement between the City of Pleasanton and The Prudential Insurance Company of America for the Hacienda Business Park project on December 6, 1983, and Phase II on April 22, 1986; and WHEREAS, the City Council further approved the First Amendment to the Phase I and Phase II Development Agreements on June 15, 1993, and the Second Amendment on October 20, 1994; and WHEREAS, at its duly noticed public hearing of September 26, 2007, the Planning Commission considered all public testimony, relevant exhibits, and recommendations of the City staff concerning this application; and WHEREAS, this project is not defined as a project by the California Environmental Quality Act (CEQA), Sections 15060 and 15378; and WHEREAS, the Planning Commission determined that the Third Amendment to Phase I and Phase II Development Agreements between the City of Pleasanton and Prudential Insurance Company of America for Hacienda Business Park is consistent with the General Plan. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Recommends approval of the application of Don Reber, BRE Properties, Inc. for a modification to the Phase I and Phase II Development Agreements for Hacienda Business Park to extend the Agreements for afive-year period from 2008 to 2013 for nine properties within Phase I and Phase II of the Park, attached hereto and made a part of this case by reference.
