PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2007-37 <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF DON <br />REBER, BRE PROPERTIES, INC., FOR A MODIFICATION TO THE PHASE I AND <br />PHASE II DEVELOPMENT AGREEMENTS FOR HACIENDA BUSINESS PARK <br />AS FILED UNDER CASE PDAM-1 <br />WHEREAS, Don Reber, BRE Properties, Inc., has applied for a modification to the <br />Development Agreements for Hacienda Business Park to extend the <br />Agreements for afive-year period from 2008 to 2013 for nine properties <br />within Phase I and Phase II of the Park; and <br />WHEREAS, zoning for the property is PUD-I/C-O (Planned Unit Development - <br />Industrial/Commercial-Office) District; and <br />WHEREAS, the City Council approved the Phase I Development Agreement between <br />the City of Pleasanton and The Prudential Insurance Company of America <br />for the Hacienda Business Park project on December 6, 1983, and <br />Phase II on April 22, 1986; and <br />WHEREAS, the City Council further approved the First Amendment to the Phase I and <br />Phase II Development Agreements on June 15, 1993, and the Second <br />Amendment on October 20, 1994; and <br />WHEREAS, at its duly noticed public hearing of September 26, 2007, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, this project is not defined as a project by the California Environmental <br />Quality Act (CEQA), Sections 15060 and 15378; and <br />WHEREAS, the Planning Commission determined that the Third Amendment to <br />Phase I and Phase II Development Agreements between the City of <br />Pleasanton and Prudential Insurance Company of America for Hacienda <br />Business Park is consistent with the General Plan. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Recommends approval of the application of Don Reber, BRE Properties, <br />Inc. for a modification to the Phase I and Phase II Development Agreements for <br />Hacienda Business Park to extend the Agreements for afive-year period from 2008 to <br />2013 for nine properties within Phase I and Phase II of the Park, attached hereto and <br />made a part of this case by reference. <br />
