DEFERRED OFF-SITE PUBLIC IMPROVEMENT AGREEMENT <br />(for items to be constructed with future Tract) <br />Ponderosa Homes <br />Busch/Ponderosa Property, Tract 7381 <br />T IS AGREEMENT made and entered at Pleasanton, California, this 6 ~~i <br />day of ~~ , ,~r , 2003, by and between: <br />Ponderosa Homes II, Inc. <br />6671 Owens Drive <br />Pleasanton, CA 94588 <br />Phone: 925-460-8981 <br />(hereinafter referred to as "Subdivider") and the CITY OF PLEASANTON, a general <br />law city, located in Alameda County, California, acting through the City Manager and the <br />City Clerk, (hereinafter referred to as "City"). <br />WHEREAS, Subdivider has a approved tentative map for said tract, lying within <br />the boundaries of the City duly approved by the Planning Commission; and <br />WHEREAS, Subdivider has presented: <br />a) conceptual offsite improvement plans, as per project conditions of approval, <br />for Iron Horse Trail and associated landscaping improvements from Busch Road <br />to Mohr Avenue designed by Isaacson, Wood and Associates dated <br />September 29, 2003, and subsequent revisions to the plans prepared by Isaacson, <br />Wood And Associates and approved by the City Engineer; and <br />b) "Free running right lane at Valley Avenue and Stanley Boulevard" designed <br />by Ruggeri Jensen Azar & Associates dated September 4, 2003 and subsequent <br />revisions to the plans pepared by Ruggeri Jensen Azar & Associates and <br />approved by the City Engineer; and <br />c) "Bernal Avenue Dual Left Turn Lane Widening at Bernal Avenue/Sunol <br />Boulevard/First Street" designed by Ruggeri Jensen Azar & Associates dated <br />July 14, 2003 and subsequent revisions to the plans prepared by Ruggeri Jensen <br />Azar & Associates and approved by the City Engineer; and <br />d) "Design and construct a storm drain system along the east side of Martin <br />Avenue from Mohr Avenue to existing pipe stub-out at the north end of Martin <br />Avenue" (collectively "Public Improvements"); <br />Offsite Public Improvement Agreement for items to be constructed with future Tract <br />Project: Tentative Map -Tract 7381, Busch Road/Mohr Avenue <br />Page 1 of 9 <br />
