ON SITE SUBDIVISION IMPROVEMENT AGREEMENT <br />(for items to be constructed with future Tract) <br />Ponderosa Homes <br />Busch/Ponderosa Property, Tract 7381 <br />THIS AGREEMENT made and entered at Pleasanton, California, this _ <br />day of ~~ml~v , 2003, by and between: <br />Ponderosa Homes II, Inc. <br />6671 Owens Drive <br />Pleasanton, CA 94588 <br />Phone: 925-460-8981 <br />(hereinafter referred to as "Subdivider") and the CITY OF PLEASANTON, a general <br />law city, located in Alameda County, California, acting through the City Manager and the <br />City Clerk, (hereinafter referred to as "City"). <br />WHEREAS, Subdivider has a approved tentative map for said tract, lying within <br />the boundaries of the City duly approved by the Planning Commission; and <br />WHEREAS, Subdivider shall provide plans for common open space and <br />recreational improvements, private access roads, street trees, all infracture, landscaping <br />improvements, etc., as per project conditions of approval and specifically Condition of <br />Approva176 of City of Pleasanton Ordinance No. 1866 dated September 3, 2002; <br />WHEREAS, said plans and project conditions of approval require guarantee of <br />installation that the Subdivider intends to construct to the satisfaction of Planning <br />Director; <br />WIIEREAS, as a condition precedent to allowing the project to commence and to <br />accepting any offers of dedication by Subdivider, City requires the improvements of the <br />above mentioned items at Subdivider's expense and certain protection for the City on <br />behalf of the public; <br />NOW, THEREFORE, in consideration of the faithful performance of the <br />promises, terms, conditions and covenants set forth herein by Subdivider and the <br />approval of the project, the parties hereto agree as follows: <br />1. Time of Essence. Time is of the essence in the performance of this <br />Agreement. The work and improvements required by this Agreement to be completed by <br />Subdivider shall be completed within two (2) year from the above-mentioned date of this <br />Agreement. <br />On site subdivision Improvement Agreement for items to be constructed with future Tract <br />Project: Tentative Map -Tract 7381, Busch Road/Mohr Avenue <br />Page 1 of 8 <br />
