STREET IMPROVEMENT AGREE'"IENT VALLEY AVENUE LAtdDSCAPE I?~pROVF~'IENTS AND MASONRY SOU~InWALL SANTA RITA ROAD TO KOLLN STREET PLEASANTON, ALAMEDA COUNTY, CALIFOR~dIA THIS AGREEMENT made and entered at Pleasanton, California this 26th day of July, 1983, by and between: SENTE ASSOCIATES SEVEN AND VALLEY BUSINESS ASSOCIATES 5820 STONERIDGE ?'4ALL ROAD, SUITE 300 PLEASAPdTON, CALIFORNIA 94566 (hereinafter referred to as "Developer") and the CITY OF PLEASANTON, a general law city, located in Alameda County, California, acting through the City Manager and the City Clerk (hereinaf_ter referred to as "City"). WHEREAS, Developer has filed with the City of Pleasanton a Final Subdivision Map for Tract 4889, in the City of Pleasanton; an d WHEREAS, Developer desires to improve the access to said subdivision by installing landscape improvements and masonry sound- wall on Valley Avenue between Santa Rita Road and Kolln Street; and WHEP.EAS, Developer is required by Ordinance No. 1084, Major Modification to Case PUD 79-13, to install a masonry soundwall three feet in from the curb Line along the eastern boundary of the 30' wide landscape buffer. NOW, THEREFORE, in consideration of the .faithful performance of the promises, terms, conditions and covenants set forth herein by Developer and the approval of the map by the City, the parties hereto agree `as follows 1. -Time of Essence. Time is of the essence in the performance of this agreement. The work and improvements required by this agree- ment to be completed by Developer shall be completed within one (1) year from the above-mentioned date of this agreement.
