STREET IMPROVEMENT AGREE'"IENT <br />VALLEY AVENUE LAtdDSCAPE I?~pROVF~'IENTS <br />AND MASONRY SOU~InWALL <br />SANTA RITA ROAD TO KOLLN STREET <br />PLEASANTON, ALAMEDA COUNTY, CALIFOR~dIA <br />THIS AGREEMENT made and entered at Pleasanton, California this <br />26th day of July, 1983, by and between: <br />SENTE ASSOCIATES SEVEN AND <br />VALLEY BUSINESS ASSOCIATES <br />5820 STONERIDGE ?'4ALL ROAD, SUITE 300 <br />PLEASAPdTON, CALIFORNIA 94566 <br />(hereinafter referred to as "Developer") and the CITY OF PLEASANTON, <br />a general law city, located in Alameda County, California, acting <br />through the City Manager and the City Clerk (hereinaf_ter referred to <br />as "City"). <br />WHEREAS, Developer has filed with the City of Pleasanton a <br />Final Subdivision Map for Tract 4889, in the City of Pleasanton; <br />an d <br />WHEREAS, Developer desires to improve the access to said <br />subdivision by installing landscape improvements and masonry sound- <br />wall on Valley Avenue between Santa Rita Road and Kolln Street; and <br />WHEP.EAS, Developer is required by Ordinance No. 1084, Major <br />Modification to Case PUD 79-13, to install a masonry soundwall <br />three feet in from the curb Line along the eastern boundary of <br />the 30' wide landscape buffer. <br />NOW, THEREFORE, in consideration of the .faithful performance <br />of the promises, terms, conditions and covenants set forth herein by <br />Developer and the approval of the map by the City, the parties <br />hereto agree `as follows <br />1. -Time of Essence. Time is of the essence in the performance <br />of this agreement. The work and improvements required by this agree- <br />ment to be completed by Developer shall be completed within one (1) <br />year from the above-mentioned date of this agreement. <br />
