<br />f~ <br />REIMBURSEMENT AGREEMENT FOR <br />INSPECTION SERVICES OF RUBY HILL PUMP STATION <br />THIS AGREEMENT is entered into at Pleasanton, California, this jSTday of _ <br />~/ZC ` 1994 by and between the CITY OF PLEASANTON, Alameda County, <br />California, a municipal corporation ("City")and Signature Properties ("Developer")with <br />reference to the following facts. <br />A. Developer is the owner of certain real property in the City of Pleasanton, <br />County of Alameda, State of California, commonly known as Ruby Hill (the <br />"Property"). Developer has obtained City approval of a tentative map for an 850 unit <br />single-family residential project to be constructed on the Property. <br />B. In connection with construction described above, Developer is required <br />to construct a water pump station and reservoir. <br />C. City desires to contract directly with John Carollo Engineers for <br />inspection services, shop drawing review, and related documents for Ruby Hill water <br />pump station, reservoir and telemetry. <br />NOW, THEREFORE, IT IS AGREED AS FOLLOWS: <br />1. Work Developer is constructing the Ruby Hill Pump Station, reservoir <br />and telemetry as per plans and specifications approved by the City Engineer. As part <br />of the construction, City desires to contract directly with its consultants to complete <br />shop drawing review, assist in change orders, and periodic inspection. <br />2. Reimbursement. Developers agree to reimburse City for all costs for all <br />work described in Paragraph 1 above. No overhead shall be charged by the City. <br />Developer shall make payment to the City within thirty (30) days after the receipt of <br />invoices from City. <br />3. Amount. Developers shall pay the City a total amount not to exceed <br />554,000.00 for the work described in Paragraph 1. <br />4. Term. This agreement shall remain in effect until such time as the <br />Ruby Hill pump station, reservoir and telemetry is completed and accepted by the <br />City. <br />5. Compliance with Laws. The Developer shall comply with all applicable <br />federal, state, and municipal laws, rules, and ordinances. No discrimination shall be <br />made by the Developer in the employment of persons to work under this contract <br />because of race, color, national origin, ancestry, sex or religion of such person. <br />
