The HOA wanted to ensure that if the Vehicle Code were applied to roads in Ruby Hill, <br />golf carts would still be permitted to be driven on the roads without complying with the <br />registration, licensing, and equipment requirements of the California Vehicle Code. <br />The Vehicle Code regulates the operation of golf carts on public roads and, in certain <br />instances, on private roads. The law regulating golf carts in this situation (i.e., operating <br />a golf cart on private roads to which the Vehicle Code has been applied pursuant to <br />California Vehicle Code §21107.7) is not clear, however a reasonable interpretation of <br />the Code supports the HOA's request. <br />The Police Department supports the registration, licensing and equipment exemptions <br />with the qualification that golf carts would still be subject to the equipment requirements <br />(i.e., lighting) of section 24001.5 of the California Vehicle Code when the golf carts are <br />driven at night. <br />Although the resolution proposed includes exemptions relating to registration, licensing <br />and equipment for golf carts, golf carts would still be regulated by other sections in the <br />Vehicle Code. Examples include: <br />• A driver's license is required to operate a golf cart (CVC §24001.5). <br />• Passengers must be seated; i.e., no one may be hanging off the side (CVC <br />§21712). <br />• Speed limits must be followed; golf carts may not be operated on roads <br />whose speed limits exceed 25 mph (CVC §21716). <br />• Stop signs must be obeyed (CVC §22450). <br />• Golf carts driven at night must be equipped with proper lights (CVC <br />§§24001.5). <br />• Drivers are prohibited from driving under the influence (CVC §23152). <br />Enforcement Remains at the Police Deaartment's Discretion: If the resolution is <br />adopted, all of the provisions of the California Vehicle Code, with the exceptions relating <br />to golf carts as discussed above, shall apply to all of the roads within Ruby Hill. <br />Enforcement would not begin, however, until all the appropriate signs, etc. are in place. <br />Moreover, the enforcement of the Vehicle Code shall be at the discretion of the Police <br />Department, and the City shall not be required to provide additional staff or other city <br />resources to accommodate it. Should the HOA desire, it may annually provide the <br />Police Department an update on traffic status in Ruby Hill. Should the resolution be <br />approved, staff will work with the HOA to ensure that traffic signs, signals, markings, <br />and devices which conform to the uniform standards and specifications adopted by the <br />Department of Transportation are installed in Ruby Hill. <br />Page 3 of 4 <br />
